My brother in law (FBI Special Agent), assigned me the task of finding someone to trade a Glock 27 for his Glock 22. I posted it here and on another forum, no takers.
When I pulled the ads, I started to wonder about the legality of what I was doing.
He lives in Wisconsin, I live in Illinois. I have his gun to sell or trade. If I sell it to someone here in Illinois, what kind of problems does that buy? I know I cannot go across state lines to sell or buy a handgun, but if the gun is brought across state lines, then what?
Gun is currently in my safe waiting for a reply. My gut says to give it back and wish him luck.
 
A non-licensee (which I assume you are) may only acquire a handgun from a licensee in their state of residence. So even if your brother in law were a licensee, since he is not in your state he cannot legally transfer a handgun to you, or any other resident of your state.

Tell your brother in law to get his gun and take care of his own business. Also tell him that since he doesn't seem to understand the federal gun laws maybe he should call up one of his peers in ATF for advice on selling/trading his pistol.
