repair facility and shipping

recently i sent my mauser 98 off to have some work done (sent to the ffl). now, the 'smith is done w/ the work, and wants to ship my gun back, but says he has to ship it back to me via a ffl (i am not a holder). i am under the impression that he doesn't have to send it back to me thru an ffl (and go thru the check and pay x-fer fees again on the same gun).

who's right? anybody have a link? i tried searching the atf's page, but can't find anything. appreciate any help!

PART 478--COMMERCE IN FIREARMS AND AMMUNITION--

Subpart I--Exemptions, Seizures, and Forfeitures

Sec. 478.147 Return of firearm.

A person not otherwise prohibited by Federal, State or local law may
ship a firearm to a licensed importer, licensed manufacturer, or
licensed dealer for any lawful purpose, and, notwithstanding any other
provision of this part, the licensed manufacturer, licensed importer, or
licensed dealer may return in interstate or foreign commerce to that
person the firearm or a replacement firearm of the same kind and type.
See Sec. 478.124(a) for requirements of a Form 4473 prior to return. A
person not otherwise prohibited by Federal, State or local law may ship
a firearm curio or relic to a licensed collector for any lawful purpose,
and, notwithstanding any other provision of this part, the licensed
collector may return in interstate or foreign commerce to that person
the firearm curio or relic.

i sent the email w/ the link to him... hope he decides to send it direct to me so i don't have to go thru the x-fer process again! local usps told him he had to have an ffl...
 
Aha! If he's shipping USPS, then he probably does have to ship to an FFL - IIRC, they only handle dealer-to-dealer shipments. If he uses UPS or FedEx, this doesn't apply. Tell him to try the couriers instead of the Post Office.
