Resident versus non resident ccw permits.

Heller will probably open opportunities with the 2nd amendment.

What I would like people on this forum is to consider 14th amendment or equal protection issues, especially with regards to ccw permits.

We have large groups of people who are discriminated against by state law for no other reason than they where they physically reside.

States like Colorado, Michigan, New Hampshire, and South Carolina do not honor non resident ccw permits.

I am not a lawyer, maybe someone on this forum is and can share some legal wisdom with us.

We have enough people on this forum that we should be able to find people who would have standing.

It would seem that there probably already is case law saying that state governments have to show a compelling need to treat citizens differently.

My understanding is California got nailed by the SCOTUS when it tried to give different welfare benefits to people who just arrived in the state in the early 1990's.

The issue is the cases would probably go to at least the appeal level. The reality is that many Fed district judges don't want to rule on law, so they pass it to the appeal court just like they did with the Heller case.

Here is the thing, I believe we could get eliminate the non resident ccw permit discrimination problem which affects alot of people.

Winning on these issues could open the doors for ccw reform in the last 10 holdout states.

At the very least, I think it would be a good follow up move to the Heller case.

Great post! I got my Utah non-res specifically for Colorado. And then...

I'd be very interested to hear what cases, if any, would have standing against that kind of discrimination.
 
We here in Illinois and those in Wisconsin are pretty well had as far as those states are concerned. Actually Florida will not honor a permit that is not issued by your resident state. But at least Florida, New Hampshire, Maine and Connecuitt will issue their own non-resident unlike some others such as IIRC Michigan and California that will not. Jim.

The thread you listed does an excellent job of tackling the question of "Why doesn't EVERY state have to recognize CCW's through recipricty." I agree. It makes no sense to require states to follow other states' laws.

The original poster in this thread seems to be asking a somewhat narrower question. For example, Colorado ALREADY recognizes the Utah CHP. I have gone through the EXACT same requirements as a Utah resident, and have been issued that permit. However, because of my state of residency, Colorado refuses to recognize MY Utah CHP.

I am being discriminated against based on nothing more than geography. There is no difference between me and a resident Utah (other than less of a suntan!)

Please work on the laws in your state.

If you have a California permit and live in California it will be honored in Michigan. But California does not honor a permit from ANY other state.

You complain about states that honor resident permits from most if not all states, but not about states that will not honor any out of state permits

I wish all states were like Alaska and Vermont.
 
This is why we should work to get the national reciprocity law passed.
Or better yet work to get individual states to reciprocate. The absolute last thing that we really need is to get the feds involved in deciding what is fair.

Given that they cannot manage a restaraunt, I think it is an excellent idea to keep the feds out of it.

I live in CA, which will never recognize any other state's permits because we here are soooo special, and I still think we are better off without the feds involved.
 
Add West Virginia to that list, and I have a residence there, but officially live in Maryland. It just makes me so screwed!
