RMR issues after 10K rounds RM01 CORE

Putting this here because there's not a handgun optics sub forum... I have an RM01, auto-adjusting LED 3.25-moa RMR on my S&W M&P CORE 9L and it lasted nearly 4 years on the first battery. Since the first battery died I've been having issues with it. I replaced the battery and re-mounted it but the dot seemed to vary in brightness, inconsistent, etc. I asked here about it and was told the contacts should be bent out a tad for possibly better contact.

I have been letting my daughter shoot it without an optic for the past few months, but I want to shoot it with the RMR in a steel challenge match this new years' and I re-mounted the optic today. The optic sitting in my pocket was on (dot bright), handling it ... it was on... I bent the side and central contact points out a bit, reinstalled the battery, it was on... locating/positioning it, and preliminary installing it... it was on... then I went to final loc-tite and torque the screws and the dot was off. I removed the screws, and the optic, dot was off. removed the battery and put it back in, dot is back on.

So..... what's my plan here?

1. is there supposed to be a rubber gasket underneath the optic, between the steel mounting plate and the optic itself? I can't believe I would have lost it during removal of the optic, as I'm generally very good about retaining all parts, etc. in the same bag for reinstallation, but I suppose it's possible.

2. If it's not supposed to have a rubber gasket, could the contact with the steel mounting plate be causing a problem? If so, why didn't it for 10K rounds?

Kinda at a loss here.
