sbr no tax stamp

I met a guy at a range who was telling me about his ar with a 14.5" barrel. I asked him if he had a $200 tax stamp for that rifle and I got a blank look in return. I then explained was the nfa is and that he needs a $200 tax stamp for his rifle just like I have for my silencers.

My conversation with left me believing that he is not going to do anything about it. He said he bought is that way from an ffl (who lost his license). I suggested that he go to the local atf office and come clean pleading ignorance (accurate in his case).

What other options might he have?
 
Options? Continue shooting it the way it is unless someone goes and snitches on him?

Where I live I could probably own a full auto and no one would know the wiser unless someone snitched on me.
 
Could he go to a class III dealer and make it right through him or is the Class III dealer not able to do anything because it was never transferred to him.
 
I'd bet it's not a 14.5" barrel per law but was sold that way. I lot of 14.5" AR have the flash hider welded on to bring it to 16+" but are still sold as 14.5" barrels.
 
It might be a 14.5 barrel with a permanently attached muzzle device. That's kosher. He might not even realize that is what he was sold and just focused on the 14.5 barrel part.

If not, he should remove the upper and get rid of it ASAP. Install a 16" barrelled upper and he's now in compliance.
 
If it is an illegal SBR, he should remove the upper and get rid of it ASAP. He could then buy a legal upper, or buy a tax stamp if he wanted a SBR.
 
I also highly doubt that it is a short barrel. If it is, all he needs to do is F1 the lower and he's GTG (of course he's in violation until he actually gets a hold of that stamp). But again, I'm extremely tempted to bet cash money that he has a legal 16" gun.

Thing is, if I see something doing something that could get them in trouble I'll tell them. If they refuse to listen or do anything about it its on them.

Of course I'm not going out of my way to rat them out either.
 
Doesn't sound like a big deal to me, certainly not worth calling the ATF about or getting rid of it!!

Step 1: is the muzzle device permanently attached and sub step (a): is the length over 16"? If, yes, stop and get back to shooting. If "no" to either, go to step 2.

Step 2: Push in takedown pins, separate lower from upper. Take lower receiver (and any other AR lowers you have) to a friend or family members house to hold on to.

Step 3: Take upper to gunsmith (or do it yourself) perm attach a muzzle device that brings it to legal length...or see #4 for extra credit. (Edit, I guess you could save step #2 by just taking the upper to the smith, thus separating the SBR upper from the non-NFA lower until it comes back legal.)

Step 4: Send in paperwork and register as a SBR on a form 1. (A whole mess of sub-steps go along with this one!;) )
 
The guy should prolly not try to rob a bank with it. Marginal SBRs are rarely prosecuted, unless in conjunction with other crimes, much like 922r violations. I've run into a couple of other people around here with 14.5" barrels without permanently attached muzzle devices and gotten the same blank stare when asked about tax stamps. My guess is that ignorance of this subject is pretty common and rarely enforced, which should in no way be taken as encouragement to break the law.

Second, this is absolutely terrible advice. Sure, if the muzzle device is not permanently attached and/or is too short he should remedy that, but absolutely nothing good will come of reporting himself (even for a victimless crime).
 
He should take the upper off the lower, take it in to a gunsmith, and have a muzzle extension permanently affixed to it. The upper itself is not the firearm. The work therefore does not need to be logged for the ATF. That's it. He's legal.
 
Go to an AR manufactrers website practically, if you buy a 14.5 inch barrel it comes with a permanently attached flash suppressor, its completely legal. The total length therefore is 16 inches.
 
My advice is to forget it, its not your problem anyways it will be his if it turns out someone wants to prosecute if it indeed is an unregistered SBR.
