Self-defense or aggravated assault?

Sounds like a self-defense case to me, but looks like they are trying to sock it to him.

Police believe Ronald Medved had a score to settle when he went up into the woods along Little Pine Creek Road in Shaler before dawn Friday, carrying a 3-foot metal pipe to the spot where he knew Bryan Meier regularly hunted.
What Medved didn't know was that in addition to a hunting bow, Meier was carrying a pistol.

Medved, 44, of Third Street in Oakmont, was in critical condition at Mercy Hospital in Pittsburgh's Uptown section yesterday, after Meier shot him in the hip, police said. The gunshot wound is affecting the function of Medved's kidneys.

Allegheny County police declined to reveal the nature of the dispute or how long the two men had known each other.

Meier, 34, surrendered to authorities shortly after neighbors heard the gunshots and called police.

"I was in bed when I heard the shots," said Ron Davis of Little Pine Creek Road, a hunter who knew the sound did not come from a hunting rifle or shotgun.

"By the time I went out on the porch, police were already here," he said.

Davis said he did not know Meier, but had seen him hunting in the nearby woods a number of times. The confrontation between the two men took place in a thickly wooded area behind the home of Meier's mother.

Meier, of Phillips Road in Richland, was charged with aggravated assault. Though he is licensed to carry the pistol, Meier could face charges of violating state game laws because he had the gun while bow hunting.

He was in the Allegheny County Jail awaiting arraignment yesterday evening.

Medved also is expected to be charged with assault for his part in the confrontation with Meier. Neither man had previous arrest records.

If this is true, why did they charge him with assault?

Definitely not enough information.

Based on what we do know. That one man was hunting and the other walked off into the wood's with a pipe point to the charge being bogus.

However, there could be many, many details we dont know.
 
Right, I don't see how anyone could determine from the information that this was a self defense shooting. Granted, the shootee may have been carrying a pipe and gone into the woods to find the shooter, but that does not mean that the shootee committed any sort of act to provoke the shooter.
 
In Cali, the elements of assault (PC 240) include:

1. unlawful attempt,

2. coupled with a present ability,

3. to commit a violent injury on the person of another.

It could be a righteous case (if not a problematic one), but I agree. There isn't enough information in the article.
 
Okay, these guys had a 'past' with each other.

Sounds like a violation of the mutual stupidity law.
 
Too many "read-between-the-line" blank spaces, and TERRIBLE "investigative" reporting! WAS their a "knock-down-drag-out" confrontation? Did the shooter sustain injuries from being struck with the pipe? No statements from EITHER of the parties involved!

The mere carrying of a sidearm while BOW hunting doesn't sound like it should be a violation of any law, in my opinion. It might turn out that the shooter did the "right thing" by "winging" the idiot who ventured into the woods with a pipe for something other than a "reasonable" reason!
 
Not sure of the state law's. But in most state law's I have read while camping, fishing, or hunting (didn't specify what kind of hunting) you can open carry a pistol. Very's between state's I am sure, but I can't see a pistol being illegal on a hunt. Heck if Im going hunting my butt is carrying a pistol.
