No charges against clerk who shot robber in Ingram
Monday, January 07, 2008
By Milan Simonich, Pittsburgh Post-Gazette
The 7-Eleven clerk in Ingram who shot and wounded a knife-carrying robber will not be charged with a crime, prosecutors said today.

A review of the case determined that Kaelin Weber, 24, was justified in shooting the robber, Mike Manko, a spokesman for the Allegheny County district attorney, said in a statement.

The robbery suspect, Lawrence V. Davis, 20, of Norristown in Montgomery County, now faces an additional charge of attempted homicide, Mr. Manko said. Allegheny County police already had charged him with robbery and aggravated assault.

Police said Mr. Davis, wearing a mask and carrying a knife, entered the 7-Eleven store in Ingram about 4:30 Christmas morning. Investigators said he leaped over the counter and inflicted cuts on Mr. Weber's right hand and elbow.

Mr. Weber fired several shots at Mr. Davis, causing a number of wounds to his body. Police said none of the injuries was life-threatening.

Mr. Weber continues to work at the store

gotta buy coffee and pastries somewhere right? better to piss in your neighbors yard :)

So why did this guy drive 290 miles to rob a seven eleven?

Probably so he can be 250 miles away while the investigation ensues. But then you gotta wonder about the cost of gas on a 500 mile road trip.

Great site, lots of good information. (That's the good, now here's the bad)

To: RoadKingLarry:

I agree with you, the clerk needs some firearms training particularly on "Center of Mass" and keeping the perp down!

To: Mainsail:

Why?, you ask should the clerk get some training, don't you realize that every moment the police are searching for a perp, that's waisted tax dollars (at $3 a gallon for gas...that's precious energy!) But if for nothing else, if the perp was laying on the floor in a pool of blood, it would save the police some time tracing down the THUG! Shooting to stop the threat is what a victim hopes to achieve, but if the threat gets up to run away...then just how was he stopped? For all you know, he may run outside and mortally stab a mom, dad, or child in an attempt to make his getaway.

Sorry if I offended anyone, but when you see criminals everyday walking and talking like they did nothing wrong...it makes a person realize that our justice system is lacking some measure of deterent. Most actually have it better inside than on the street.

Oh and just so it doesn't get misconstrued, this perp that stabbed the clerk, on the prison yard hierarchy, he would rank up there with the bank robbers and murderers. What that means is, other lower ranking inmates would look up to him as a leader of sorts and he would have to live up to that rank or perish in prison...meaning he would need to kill or attempt a killing AGAIN while incarcerated!

Ok I'm done...this is a great site...Oh did I already say that? Oh well!

I think there’s a perception that a shootout will go down like it does in the moves; the good guy takes a proper Weaver stance, aligns the sights, fires, and bad guy goes down. I don’t think that in the majority of cases that is what really happens. There is a video of a cop getting into a gunfight with the driver of a car he’s just pulled over. He wasn’t expecting it, and like this situation, was probably a total surprise. In the video, the cop is firing wildly while backpedaling, ducking, and weaving. I still don’t know how he managed not to shoot himself in the off-hand with all the thrashing around he was doing. That’s how I see this shooting happening.

Additionally, unless you’re willing to pay for equipment and specialized training for convenience store employees, it’s somewhat duplicitous to trivialize this person’s choices (especially since he probably doesn’t make much more than minimum wage). You weren’t there and all any of us know about how this event unfolded is the much abbreviated report in the news.

The ‘threat’ isn’t the person. The threat is the totality of the circumstances; the person, the actions of the person, the place, etc. We shoot to stop the threat, not to make hamburger out of some punk kid robber. That’s what this guy did, he shot to stop the threat, and he was successful. He survived.
