Selling a Firearm on Auction Arms

I have a IAI M1 carbine i think I might sell on Auction arms and had a question.

I know if i sell the gun to a out of state buyer it needs to go through a FFL, if the buyer is not one.

But Can i send the gun to the FFL, or do i need to go to a local FFL and have them send it.

Depends on the receiving dealer. Technically, according to Federal law, you can ship any firearm to an FFL. However, some dealers, particularly in highly-regulated states like California, insist that they will only receive firearms from another FFL, for their own protection. So, you'd have to check with the receiving dealer for his terms and conditions before proceeding.

That's been my experience at most gunshops in Texas and Virginia and North Carolina, as well. I have found one pawnshop near me here in the DFW area that will take a out-of-state transfer from a private party, but that's pretty much the rare case. Better ask around before you bid....

Of course, if you're selling then it's the bidding party's job to find a local transfer agent. But you'd better make it clear in your auction that you are not a FFL holder.
 
Also let them know that the shipping fee will increase if you have to use an FFL to ship the rifle to their FFL.
 
One more question. If i ship to a FFL, do they need to send me a copy of their FFL?

Since you're a private citizen, you don't need their FFL. In fact, when I was in the business, our shop was very careful not to simply send a copy of our FFL with anyone. Just being careful.

The receiving shop/FFL will need proof of your identity. As a private citizen occasionally selling thru Auction Arms, I send an enlarged copy of my driver's license. It proves to the receiving FFL who I am, where I live, and that I'm over 18 (long guns) and also over 21 (handguns). Some will cringe that I've sent out my DL, but I sleep pretty well at night.
