Sending Handgun to C&R Licensee?

I have a Curio & Relic license holder who wants to purchase a handgun from me made in 1957. Can I legally sent it to the address on the license?
 
My LGS will not honor them.

Unfortunately this is not uncommon. While it is the LGS's right to refuse, (They also can refuse to honor another FFL01) it is usually lack of understanding just what a C&R license is and what laws need to be followed.
"No"is a shorter word than "Yes" so they just take the easy way out.

You could try to educate them but I have found that more often than not it just gets their backs up because they are the experts and you are just trying to put something over on them........;):evil:

Plenty of other gun stores to choose from. The nice thing about your C&R is that you can use it in any state. Head up across the line into Wisconsin and we've got dozens of places that will accept your 03 and your stack of crisp hundreds with a smile and a thanks.

The *main* reason I keep an 03 is to be able to window shop and then actually buy when I'm travelling out of state. There's nothing I'm terribly interested in that's been made in the last 50 years anyhow, and the license is a real benefit.

TX - yep
CA - nope
NY - nope
MA - ??
NJ - probably not

most states yep, socialist or semi-socialist states nope

Other than listing the states you don't like, is there any supporting documentation that you have regarding your short list of states for which you say "no"?


NJ, BTW, as a state, makes it hard to obtain a C&R, as they require as a condition of state law that ANY holder of a FFL also obtain a state license as a gun dealer. These are only issued to storefront holding businesses, and the BATFE will not issue a FFL of any sort to anyone who does not have one.

Ergo.. nobody in NJ applies for an 03 FFL.

Unfortunately, as those laws change constantly, and with out notice to anyone outside the sate/county/city, any such list would be "out of date" before the ink dried.
 
Still, something would be better than nothing, and perhaps a Wiki-like format would allow folks to update it regularly when something changes in their state/county/city?

You are certainly correct. Contacting the ATF with the question is what I've done for 10 years as a FFL 03 holder.

They are polite,professional and pleasant to deal with on the phone.
