"Police said the bullet retrieved from Shaw's body matched the .22 caliber bullets in the magazine of the handgun found in Calvin's van after the arrest."

Does anyone find this statement a little odd?

This sherriff just knows his history...German history...

Germans who wish to use firearms should join the SS or the SA. Ordinary citizens don't need guns, as their having guns doesn't serve the State." - Heinrich Himmler 1936

Post 26:

How could they match fired and unfired bullets? Not by rifling, but maybe chemical composition or other factors?

It's just circumstancial evidence.. if everything else clicks, im guessing the fact that the victim was shot with the same caliber bullets put some icing on the cake.

On that show the "The First 48" on A&E, the detectives always get happy when they catch a suspect who possesses a gun in the same caliber as the bullets that killed the victim.

Santa Barbara has over 600 gang members.

It's main street, State Street, attempts to emulate a European posh area.
Yet, a gang fight broke out there recently where a gang banger was knifed.

State Street runs north from the ocean, so, the gangsters fight over
the east side v.s. the west side.

The county Sheriff wants to use social programs to solve the gang problem,
leaving good people defenseless until these programs work out.

The city's police chief is no help. He moved there from a barrio in Los Angeles
and appears to be very comfortable with gangsters in Santa Barbara.

When I visit, I pack and never venture off the beach or certain parts of State Street.

Letter to the reporter. Letter to sheriff seems pretty useless idea.

Dear Mr. Schultz,
Sheriff Brown won't do it but maybe you will.

Read some of John Lott's books and Gary Kleck's research. Look at the crime stats for the states which have gone "shall issue" as opposed to highly controlled places like Washington DC or Philadelphia, Chicago, New Orleans. The facts of two decades of "shall issue" support concealed carry, even within the rural communities of CA, as a means to making life safer for all.

The example cited by Brown of fender benders resulting in firefights is a myth deployed anytime "shall issue" or concealed carry is advocated. Would the result have been any different in the cited case? Perhaps not, gun or no gun. Brown is claiming second-sight when he says the preseence of a gun was the difference between life and death. If he is so blessed with such prescience I am sure he can predict earthquakes and all manner of things.

If having guns about is so dangerous, then I am sure the good sheriff would disarm his troops, wouldn't he? Brown also knows I am sure that police as a matter of law have no obligation to protect any one individual, so he can deny people the individual right of effective self-defense without any legal comebacks from the dead or their relatives. He also has the luxury of being in a low-crime region, anyway, due to demographics. It isn't his skills as a LEO keeping things quiet, I suspect.

I guess Brown has read his history, though. German history. "Germans who wish to use firearms should join the SS or the SA. Ordinary citizens don't need guns, as their having guns doesn't serve the State." - Heinrich Himmler 1936. Especially Jewish citizens, but they could not join.

Just remember, when seconds count, the police are just minutes away. It is not their fault, either, because "Minority Report" was a movie, it is not what really happens. Police are reacting more than 95% of the time. There are not enough of them to go around.

Thanks for quoting from both sides in your article. Nice to see some balance

The Calvin/Shaw case has intrigued me for some time. Troubled me, really. I'm glad to see it being discussed here.

This happened about an hour from where I live, but it is a very similar area, demographically. The case is very troubling to me, because after reading all of the media accounts I could find, I still don't believe that Mr. Calvin was completely unjustified in shooting Mr. Shaw. The facts as I know them are that Shaw, with a supposedly known history of road rage, boxed in Calvin, got out of his vehicle, legally drunk, and confronted him. Shaw landed at least one blow to Calvin's face, through the open driver's window, and IIRC was winding up to throw another one when Calvin shot him in the neck with a NAA .22.

I think this is a perfect example of how a "stand your ground" law could have aided in a defense. My opinion is that Calvin got convicted because he didn't do everything he possibly might have to run away. I don't know whether he was acting aggressively towards Shaw, or perhaps baiting him, those could have been factors also. It's hard to glean details like that from the media accounts. I'm sure it didn't help that Calvin didn't summon help after the shooting, but honestly, after seeing how this turned out for him, I'm not sure I wouldn't just try to get away with it if I were in the same scenario. (Not very High Road, I'm sorry).

BTW, I think a large chunk of the 33 year sentence was because Calvin shot from inside of a motor vehicle. I remember reading that this accounted for 25 years of his sentence. It's my understanding that this sentencing requirement was in response to gang violence (drive-by shootings). You could hardly classify this as a drive-by.

I hope I got all of the facts straight. I'm VERY interested in what other members of this forum think about this case.
