Hey guys, My brother lives in California and I live in Alaska. He hasn't been able to find any .454 ammo to shoot his pistol. Can I legally send it to him? The ATF site seems to focus on Federal law. Any pointers on where I can find this info? If it's illegal I obviously will not do this. Just trying to help my brother out. Thanks

I'd be happy to help, except I'm apparently a "kommie."

So you can figure it out for yourself.

Forgive me, it was meant as light-hearted humor. I was born in Palm Springs, lived in the Mojave desert for close to 20 years. I know there are many good people there. I meant no offense, only jabbing at what the state has become. Your advice would be most appreciated .38 Special.

EDIT: Besides, the Best music ever came from Orange County

Yeah, I know, and I'm not really offended or anything. I just try to point out that the term, even though common and generally used without intending harm, is actually kind of rude. I mean, if I had a question for folks in Alabama, what kind of response would I get if I asked for help from folks in Hicktown, USA?

At any rate, it is legal to ship ammunition from private party to private party in the U.S., although there are some restrictions by county, in California. It does need to go by ground, either UPS or FedEx. The trouble is shipping through Canada. To the best of my knowledge, Canada allows the importation of up to 5000 rounds of small arms munitions to a private citizen, but the US actually requires an export permit. So I don't think your plan is technically legal.

I'm not certain that shipping from one US state to another is considered "importing ammo", even if the shipment happens to cross over Canada. I'd suggest contacting UPS and seeing what they have to say.

I imagine that shipping charges for something heavy from Alaska would be prohibitive. Why doesn't your brother simply order some from Midway or other mail order vendors?

Have him stock up now, because mail order ammo will be illegal in all of CA in 2011.

I live in Hippieville. Sometimes a spade is just a spade - no sense trying to pretend it is a heart. :neener:

"I live in Hippieville. Sometimes a spade is just a spade - no sense trying to pretend it is a heart."

Heh. I lived in a predominantly black neighborhood a long time ago. The popular black-to-black greeting was along the lines of "What up, nee-gro!" They had no problem with it. But if whitebread here had tried the same thing I wouldn't likely have survived it.

So it's funny when I call it California. But when you do it it's an insult. :D

If it is legal to ship ammo to Ca. then it's of no consequence whatsoever that the UPS plane travels thru Canada. Shipper to consignee is what's important.

Except that ammo must be shipped by ground, unless you want to do a certified HAZMAT shipment.

Why will mail order ammo be illegal in Ca in 2011. I'm new to guns so I was not aware of this.

California AB962 will, among other things, outlaw mail order ammo sales after 2-2011. There are several court challenges lined up waiting for the McDonald decision coming out in a couple of weeks. There is a good chance that AB962 will be killed by court decisions that will follow from the Supreme Court 2nd Amendment cases. Stay tuned.

Also, AB962 says nothing about shipping ammo to your brother, only that sales must be face to face. Just send it to him.

Edit: Oops, yeah. The law Only applies to handgun ammo.

I have orderred .454 ammo from on-line dealers in 2009 and had it deliverred to my home in California.

Tell him to look on-line.

Have fun reading the following - California's gun laws will make your head spin...

California gun laws can be found at this site:

http://ag.ca.gov/firearms/

Here are some excerpts from the following info bulletin that detail certain types of illegal ammo. Also, I would like to point out that shipping ammo that is belt-fed and contains more than 10 rounds linked together can violate the "Large Capacity Magazine" law, which is a felony:

http://ag.ca.gov/firearms/forms/pdf/Cfl2007.pdf

Armor-Piercing Bullets
It is unlawful for any person to manufacture, sell, or knowingly possess or transport handgun ammunition designed primarily to penetrate metal or armor. (Penal Code §§ 12320, 12321.)

Larger Caliber Weapons and Tracer Ammunition
It is unlawful to possess any of the following:
• Any projectile containing any explosive, incendiary material, or any other chemical
substance including, but not limited to, that commonly known as tracer or incendiary
ammunition, except tracer ammunition manufactured for use in shotguns.
• Any bomb, grenade, explosive missile, or similar device or any launching device
therefor.
• Any weapon of greater than .60-caliber that fires fixed ammunition, or any
ammunition therefor, other than a shotgun or shotgun ammunition.
• Any rocket, rocket-propelled projectile, or similar device of a diameter greater than 0.60 inch, or any launching device therefor, and any projectile or similar device containing any explosive or incendiary material or any other chemical substance, other than the propellant for such device, except for devices designed primarily for emergency or distress signaling purposes. (Penal Code §§ 12301, 12303.)

Also, some cities have their own laws banning certain ammo sales, such as L.A.

For actual shipping:

UPS will take the shipment in a sturdy box marked with an "ORM-D, Cartridges, Small Arms" label on the outside of the box.

Here is a site that you can find the following labels:

When I read California's laws they always seem like a trap. That's you see the following everywhere guns and ammo are sold, "No sales to California"

The cliff's notes version.... "We indend these laws to discourage the otherwise protected acts of firearms ownership. We will intreprit these regulations to suit our purposes, engaging in firearms and or ammunition ownership may violate these regulations if we so decide, resulting in a felony. AND No felons shall possess firearms or amunition."
