I'm considering selling a broken derringer I have. It doesn't fire, neither chambers, dunno why. I sent it back for some work to the company, and they sent it and the replacement back to me. So, I have this broken firearm I don't need, considered selling it to someone adventurous enough to try to fix it. However, it's not worth much to anyone if they have to pay a bunch of transfer fees just for a dinky little broken gun. Can I ship it to anyone directly without the transfer issue?

Yes, if they are in your same state or if they have a FFL. Take it to the counter at the UPS Customer Service Center or depot. They don't ask a lot of questions. Write the model number or something like that on the shipping bill for the contents, declare it's worth $50, and ship it Ground. (just be aware if it gets lost or stolen, they won't pay the claim)

It would be better to sell it face-to-face and avoid the shipping thing completely.

Interstate, only a licensee (like a dealer, gunsmith, or manufacturer).

Intrastate, you can ship it to any non-prohibited person, as long as your state laws don't prohibit transfers between non-licensed private citizens.

The fact that the gun is broken doesn't change the fact that it is a gun, unless the receiver (whatever is the serial-numbered part) has been completely destroyed so that it cannot be readily repaired to working status.

I can, but I'm in the panhandle of WV, so much closer to other states than the majority of my own state. So almost any sale I'd do would require an FFL.

Well, you can still sell it locally. Lets say someone over the line wants it. Simply meet them at their FFL. They pay for the background check, and then hand it over to be logged and sold.

You don't have to ship it from an FFL or anything like that just because they're in a different state, it's just that the BUYER needs to pick it up from an FFL.

It's just a shame because it's a cheap item, and most FFLs are $25+ for the fee.

I don't want to make a stink, and I won't mention any names, but a user here contacted me about purchasing it. They asked about "avoiding the FFL fee." I asked them to clarify, and they were pretty straight-forward, they wanted me to ship it straight to them.

I told them I didn't want to commit a felony. They then ridiculed me for "trusting Obama so much" that I'm only willing to do a sale if he can track it so that it might help him when he decides to take them from us. All misinformed paranoia aside... A HighRoad member just asked me to commit a felony, and then when I told them no, gave me a hard time.

I feel like this is a very informed website. We're all pretty intelligent and know the laws, and do our best to abide them at all times. This is not acceptable behavior, and I thought it should be mentioned.

You're right, it's not acceptable. IMHO, you might want to contact a Mod and give them the individual's name, so they can look into it and possibly remove the...misguided user from our ranks. We don't need anyone who is willing to commit felonies in our midst.

If they are a resident of your state, and not known to you to be prohibited from owning a firearm, then that would be legal. (Assuming your state laws allow.)

If they are not a resident of your state, definitely two felonies (at least) involved.

Anyone who receives a solicitation of illegal should inform a Staff member immediately. We cannot, and WILL not knowingly host or aid illegal practices.
