So I want to put a shotgun in the truck. In Texas you must have it in the open or in a manufactured case. I hve been brainstorming ideas to keep it in the open but not getting my truck broken into so I have decided to fasten in to the headliner :D

What do yall think? How should I do this?

You can have ANY weapon in your vehicle as long as it is something you can legally own and it is concealed. There is no stipulations as to how it is concealed.
If it is a four door, just mount a regular gun rack behind the rear seat and put it there. cable lock it so it can't be taken out easily and keep the key to the lock on your car keys.

I have a 3 long gun holder that is zippered pouches. It hangs behind the front seat of my Suburban. I only have front seats in my Suburban. It is handy. 12ga on top, 223 next and 22 on the bottom

How do you guys secure your weapons from being stolen? A while back, I woke up to a notice taped to my door from the PD saying several cars were broken into the night previous. I had left a handgun in my truck, locked in a safe, but the moment I read that notice I realized how easy it would be to break into for someone motivated enough. I don't, as a rule, leave guns in unattended vehicles anymore unless there is absolutely no other choice.

By the way, I was lucky. They passed over my 15-year old ride for the newer vehicles.

...can you cite the "in the open" and "manufactured case?" Never found this wording in Texas law...I put mine with the barrel on the floorboard and the stock up beside me in the seat...never read a word in Texas law regarding long guns in a vehicle...hard to keep the weight up in the headliner area...most bangers are short and would see it anyways...if they looked up...

I carry mine in a gun rack inside of my truck. I also have 2% window tint installed. My tag says Gunluvr so there's no surprises for the cops or the crooks. They can try to take it but it's 50-50 on whether they get it and 70-30 against them if I see them trying.

If you do a search for headliner gun rack you will find them

I've never seen one for headliner mounting and have serious doubts about whether it will support a long gun over time.

I got two from Cabelas several years ago. They don't work in my current vehicles. Send me a pm, perhaps we can work out a deal. These are screwed into the roof. I was comfortable when I was using one in a Buick sedan. My Xterra sets high enough that the rifle would be visable to anyone casually looking into the vehicle. I really liked the rack in the Buick. I could access the rifle quickly and easily. It was a .17 HMR that I used to shoot ground squirrels on our property. Search Cabelas for Big Sky Racks Bar Gun Rack. Mine is the kind that holds only one gun.

Uh Oh is your Xterra an 06? :banghead:

Texas H.B. 823 prevents the police from routinely arresting a law-abiding person who is transporting a concealed pistol in his motor vehicle. This is accomplished by clothing a law-abiding person with the presumption of being a traveler. The traveler presumption may be rebutted by the state by presenting proof beyond a reasonable doubt. In plain terms, a law-abiding person should have no problem transporting his pistol in a motor vehicle provided the pistol is concealed.”

But after rereading it looks like I was mistaken, it appears concealed only applies to handguns. Hopefully someone who is better versed can clarify.

Old info. This has been superseded by HB 1815. http://www.dallasobserver.com/2007-10-25/news/have-gun-will-travel/

which says in essence "The new law, the first bill Governor Rick Perry signed from the last session of the Legislature, now allows gun owners without a permit to carry a concealed gun both "to and from" their premises and their vehicles. Guns can be carried in cars with a few restrictions: They must be hidden from plain view, and the owner cannot be involved in criminal activity or a criminal street gang or otherwise prohibited by law from carrying a weapon."

Gotta love Texas!

When I lived in TX back in the late 70's, everyone had a rack in the window - but then no one even thought about stealing your gun.........

How about one of the devices that hold it behind the seats?

Years ago when I had a pickup with a bench seat I used a seat cover like this
http://www.autoenhance.com/saddle.html
to carry my lever action rifle. The way this is made, my rifle was held in a pocket (they call it a scabbard) that was sewn into the seat cover. It held the rifle low and tight against the front of the seat. Nobody would ever know it was there unless they groped around looking for something. And it was real fast to pull the rifle out; but you have to be standing outside the truck with the door open to do it. I think this would work well with a shotgun, if your truck has a bench seat.

Text of Texas HB 1815 does not say...

..."gun"....it addresses specifically and ONLY handguns:
http://www.capitol.state.tx.us/tlodocs/80R/billtext/html/HB01815F.HTM

...no Texas law that I have ever found addresses carry of a long gun in vehicle, concealed or otherwise...it is still legal to carry a long gun openly in public...
...it would do to check Texas Wildlife Laws to see if any restrictions exist connected with hunting laws...not aware of any but I don't hunt...

...Dallas Observer...or any newspaper...is not a safe source for law...the law ALSO does not mandate that the handgun be concealed while enroute to one's vehicle...only that once in the vehicle it must be concealed...

Wow, lots of wrong info in this thread. I'm kind of shocked actually.

Texas has basically NO long gun laws (other than hunting laws around what can be used to hunt).

Concealed, open, loaded, unloaded, cased, not cased, burlap sack if you want.

Heck, strap it to the hood and that would be legal too.

I always find it funny when people ask for a cite of something that is LEGAL to do.

Texas Penal Code 46.02 - Unlawful Carrying of Weapons

Sec. 46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun, illegal knife, or club if the person is not:
(1) on the person's own premises or premises under the person's control; or
(2) inside of or directly en route to a motor vehicle that is owned by the person or under the person's control.

Penal Code 42.01 covers Disorderly Conduct, really the only other place firearms are mentioned:

(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm;

Laws only make things illegal. So, if it's not mentioned, it's legal. Texas Penal Code ONLY addresses handguns as far as carrying, not a word about long guns.

ETA: Nothing in the hunting laws either:

TexasRiflleman beat me to it. .

Long guns can be carried in your vehicle or bicycle or person (if you're walking) in any manner of carriage you like.

. . . and yeah, the stuff is thick in this thread.

Rode my motorcycle to the range with a FAL slung over my shoulder a couple of times.

The sad thing isn't that people don't know the details of the law, that stuff can be confusing. The sad part is that people automatically assume there must be lots of restrictions simply because a gun is involved.

That's the media and the anti's working their magic over the years, even in places like Texas.

...nobody asked for a citing on what was legal...both of us asked for a cite backing up the statements that others made that were both false...
