Sky's the limit for large bore destructive devices. Yes, you can build a 105mm if you want, but your ammo would have to be solid/inert. If you wanted to build explosive rounds, they'd each be destructive devices which make them a little pricey to shoot. (With a $200 tax stamp each...)
Not all rifles over .50" are considered DDs. Certain cartridges have been exempted like the .600 NE and JD Jones' 14.5mm.
Hey you can build and buy pretty much anything you want, as long as you've got the money and a squeaky clean background. Now that is going by the fed. gov. your state may say else wise.
That's why with all her faults I still say God Bless America and in an interesting note, so does your money, coincidence?
BP and smoothbore have little to do with it; the fact it's an old (pre-1898) design and doesn't use fixed cartridges (primer/powder/projectile together) makes it exempt from being a large-bore DD.
