I live in Florida and want to buy a handgun from another florida resident. the seller lives hundreds of miles away. Can he legally ship the gun to me within Florida, intrastate? It is not C&R transaction. Thanks

well, in Texas

Texas residents can ship longarms to fellow Texas residents without having to go thru an FFL intermediary--according to ATF rules. I am not clear on handguns. However, if it is legal to ship handgun w/in the state to fellow resident, you will pay an overnite shipping fee to UPS (one of the few who will ship handguns) and it is around $50, and can only be done at a Customer Service Center--not to be confused with the strip mall UPS stores.

This issue has been raised in the "Legal" section, so might best do a search there or post a new thread.

Handguns in FL

I too live and sometimes work in the sunshine state, :D. For a handgun sale from an out of state resident, you'd need to go to a FFL holder/gun shop near you, have them send a valid copy of the shop's FFL to the other party(if they are a FFL holder) then you pay for the firearm to the person who owns it, they send it to the gunshop/FFL holder by next day air/express mail insured and you go to pick it up. The gunshop you use will also make you pay for and get a FDLE(Florida Dept of Law Enforcement) background check too, ;). This entire process may take a few days or maybe a week. I have bought handguns from out of state sources and from online, www.gunsamerica.com. I never used a private owner just gun shops/FFL holders.

I just re-read your post. For in state handgun sales, you'd need to pay the person and have them mail the handgun, INSURED, by express/overnight mail like FedEx or UPS. Do not use the US post office! In state sales do not require a FDLE check or FFL holders in Florida.

PM me if you have any other FL based firearm questions.

Rusty

PS: I think you can legally mail/ship unloaded handguns in local stripmall type UPS locations. I FedExed a Beretta 96D from FL to AZ and the clerk did not even say anything...

Provided there is no state or local law to the contrary, you may ship (not mail by USPS) a handgun to another resident of your state without going through an FFL dealer. But it seems the carriers generally will not accept a handgun addressed to other than a federal licensee, no matter what the law says.
