Stabilize braces

Not a terribly difficult legal question, and almost more appropriately posted in the NFA firearms section, but here seems fine since the appropriate legal answer would be to write the ATF and find out.
Not much discussion that way, but they are very helpful and polite.:)

If the firearm is a pistol, one may put a brace on it, as shown in the advertisement, even with a stock adapter. But, one may not put a stock on it without first filing and obtaining a tax stamp for it.

The piece linked to looks as though is needs another piece to attach a ubiquitous pistol buffer tube to.
As long as it is not a rifle stock, a human could use Duck Brand duct tape to attach it with, if they were so inclined.:D

An interesting question I would have is, if one made their own wire brace at home for it, if our oppressors would allow it to be deemed a brace, but I don’t want to derail so I won’t ask.;)
 
There are several companies that already make pistol braces for the Mac 11 and the numerous copies. KAK industries makes one with adapter plate

Legally and practically, using an already manufactured and approved brace is the best bet. Any type of handmade or modified design would need to go through FTISB to be legal. Filing for a variance (or having the right FFL do it) is the place to start when making your own brace.

As for only using "approved" pistol braces, I don't believe there is such a thing. Some pistol brace manufacturers may have asked for and received determination letters from the ATF Technology Branch, but as we have just experienced with Bump Stocks, those determination letters hardly constitute settled rulings, and can be rescinded at will by the ATF.

Further, as we have recently seen, even a brace with a favorable determination letter, if fitted to a pistol that is too heavy or has too long of a length of pull to satisfy the ATF, even though they have not yet provided objective criteria for either, can still result in a firearm that is ruled to be an SBR by the ATF.

I'm afraid that this is one of those 'proceed at your own risk' situations, and you may wish to consult legal counsel.

AFAIK, the process for applying a variance to a firearm is the same as for a defining accessory like a pistol brace. Nothing I have read in ATF lingo shows a separate process for a firearm variance vs adapting a pistol brace. If someone knows any better I would like to know. Navigating the ATF minefield is something everyone benefits from.

Very true. The ATF is given far too much leeway in interpreting and enforcing vague firearm rules. But until the ATF is done away with or given some meaningful oversight, we are forced to play by their rules.
