Please Contact Your Local Officials!



Several Tennessee counties and municipalities have started the process to opt-out of the new park carry law before its effective date (Tuesday, September 1). We have included a list of cities and counties that are considering opting-out or have scheduled hearings on the issue. Please make your voice heard to keep this from happening.



The best way to get your opinion through to your local officials is to contact them immediately. Please respectfully urge them to oppose any proposal or resolution that would prohibit law-abiding permit holders from protecting themselves in local parks. The following cities have scheduled hearings on the issue for Tuesday, July 14.

This is about TN localities opting out of Tennessee's new state law that permits handgun permit holders to carry in state and local parks.
 
What I do not get is that I thought only Federal and State could make gun laws. Since when do cities of the same state get to choose laws like this? So could one city just choose to ban all handguns?
 
I was unaware that Tennessee did not have a state preemption clause in their state laws regarding weapons carry.
 
My understanding of the law was the cities can opt out on local parks such as sporting fields and events and facilities that are for the cities such as walking trails.My understanding is state parks allow carry as of Sept 1st. The Murfreesboror Mayor and all but one of the councilman vetoed carry in city parks. Therefore, I am denied the right of self protection. Byron
 
State parks are covered by the state rules. Local makes it's own rules until they get sued to reverse them.
 
The actions of the cities do not affect the right to carry in state or national parks in Tennessee. They only have the right to regulate gun carry in their city/county park areas. While this right would normally not exist due to State law pre-emption, the State Legislature included this exception to pre-emption when the bill to allow carry in Tennessee state and local parks was passed. It was part of a political trade-off to get the bill passed. Obviously, most city governments are opting out of allowing carry in city parks (but not all are opting out!).
