I did a search and didn't see this posted:

FORT WORTH (CBS 11 News) ―

A Fort Worth businesswoman was almost robbed at her shop, but a neighbor comes to her rescue. In the end, the man suspected of the crime is shot and killed.

Chong Im Randle, who friends call Angel, described her conversation with the would-be robber. "I say you not to shoot. Okay, you kill me I'm going to heaven. You go to jail."

By Friday afternoon Angel appeared calm and collected as she detailed the morning's activity. "He followed me, then grabbed me. I hit him with my elbow."

Randal says 45-year-old Richard Lane wore a mask when he broke into Happy Donuts around 1:30 a.m., with what looked like a rifle. He stole money from the cash drawer, beat Randal up and tried to steal her car.

"I grabbed my telephone," Randal explained. "He said, don't call police. I say I gotta do something."

Meanwhile her neighbor, 54-year-old Stanley Livingston, heard the commotion next door, grabbed his shotgun and ran over to help. That's when Lane allegedly pointed his gun at Livingston, who fired one shot killing the robber.

Fort Worth defense attorney Trey Loftin told CBS 11 News, "We're a gun toting state. We have a lot of John Wayne in our blood. We're gonna shoot first and ask questions later." Loftin says Livingston will most likely not be charged.

Randal, who says this morning's robbery was the second in two weeks, is grateful her neighbor was there. "If my neighbor no come, what is gone happen? I might die."

According to Fort Worth police Lane was armed with a BB gun rifle during the robbery. State records indicate Lane had an extensive criminal history, including aggravated assault and aggravated robbery.

After talking to police Randal was back in the store. She said she had to keep her promises to customers. "We have orders that have to be delivered," she said.

Turned out well for the good people just trying to make a living and poorly for the bad guy. Can't ask for any better.

The only problem may arise if the robber's family tries to sue because he was a "good person who was just confused".

Not likely, our Castle Doctrine covers pretty much all of that.

God bless the Castle Doctrine.

Texas does have that now, right?

"We're a gun toting state. We have a lot of John Wayne in our blood. We're gonna shoot first and ask questions later."

They should rename the Castle Doctrine the "John Wayne Doctrine"...

And what question was Mr. Livingston supposed to be asking with a gun pointed at him by a masked robber?

That's how is done in Texas!

:neener:

Bringing a BB gun to a shootout is dumb as it gets. I nominate this guy for a Darwin award.

It's a shame that people get caught up in messy stuff (drugs, depression, desperation, etc) and then do something that ends or forever alters their life. However, it's a bigger shame when their actions alter somebody else's life.

Thank God for neighbors like Mr. Livingston. I hope he doesn't lose any sleep over the shooting.

As for "allegedly" pointing the BB gun at Livingston - who cares? He already needed to be shot.

Also, we spend so much time and energy debating the merits of various firearms. Chalk one up for the good old fashioned shot gun.

Indeed...assuming that there's even time to ask a question.

Good, albeit confused/misunderstood people can kill you, too...and they don't normally engage in lengthy conversations before they act.

I hate that a man is dead over a little money. I'm sure that he had his good qualities, like everybody else. However, if he points a gun at me...his personal issues and basic goodness aren't foremost in my mind as the Fight/Flight response kicks in.

If it was a donut shop, why wasn't there already a cop there?

At 1:30AM, shop was likely closed. Article didn't say if it was a 24-hour shop, but since story did say Mr. Lane "BROKE IN", that makes me think shop was closed.

The way it aughta be.....

Probably. The little family donut store near me opens at 5am but they are there rolling the dough a little after 1.

They do LOTS of cash business and likely have tons of cash on hand to make change for later in the day.

That would make a good target for someone like this. Too bad he didn't take the neighbor into account in his planning (too bad for him anyway).

Once again, the best way I've heard it put is "Catastrophic Failure of the Victim Selection Process." In this case, due to a good samaritan neighbor. :)

Now that is what I call confidence. In her belief and the Judical system.:)

An interesting comment from a defense attorney.

I also have to wonder. Given this guys record, you'd think he'd been to prison at least once. Didn't his boys teach him NEVER to rob a 24 hour donut shop? Talking about stacking the deck against yourself.

It is indeed a shame he chose to risk, and in doing so forfeit, his life over what could only be a comparitively small sum of money.

and the 2008 Darwin award goes to....

First of all, who robs a donut shop at 1:30 in the morning? If they just opened, how much cash would be there.... Second... A donut shop? I would expect alot of cops have sampled their wares... might as well rob a police station.

Third... and I do mean this... If you rob any store with a BB gun, you are a prime candidate for the Darwin Award..... and rightfully so.

I think what we have here is a simple case of rectal-cranial inversion.

A surprisingly large amount it turns out. These places have to have enough currency to make change all day for people paying for their $3 worth of donuts with $20 bills.

You'd be surprised how many $1's and $5's that takes.

Yeah, they will have a large amount of cash, given the very cash-heavy nature of the business.

Yet, in the grand scheme of things, it isn't all that much cash, certainly not to risk one's life on. It most definitely does not fit in that category of money that would require me to walk naked down main street (which I will do for roughly $1,000,000).

I think I've spotted the problem: if you let criminals out of prison, they're going to commit crimes. So hard to figure out!

This is why I finally started to CCW. It took me awhile...but I finally realized the "justice" system cannot - or for reasons unkown - will not - keep violent predators out of society. Not even when they catch them repeatedly.

Catch and release is great for trout fishing. Not so much violent sociopaths.
