New Law now in effect in Texas concerning carrying in your vehicle. This became "carved in stone" as of 9/1/07. For those who might not be aware of it.

Also, this change in CCW laws (Texas):"Changes to concealed carry statutes
Speaking of CCLs, holders of concealed handgun permits will only have to renew their permit every 10 years instead of five, as the law previously stood. In addition, the names of CCL permit holders will no longer be public records."

I have a question if anyone knows. Is this "Grandfathered" in? Mine is do to be renewed in 2010. With the added 5 years will that be 2015, or is it for CHL's issued 9/1/07 forward? Thanks!
 
It's floating around in my brainpan that the Harris county DA refuses to comply with this new law and continues to instruct LEOs to arrest people CC a handgun in their car.

We were talking about this at work and I'm unclear.

Can anyone authoritatively speak on this question?
 
It's my understanding that the Harris County DA actually was ignoring the old new law, which was passed in 2005. It had been legal for a while for people to have loaded handguns in vehicles while "traveling," but didn't define "traveling," and the new 2005 law basically said that if you were in a car and not doing anything illegal, you were presumed to be traveling. The Harris County DA said he didn't care and would prosecute people by attempting to prove the weren't traveling.

The new (2007) law basically makes your car a part of your house with regards to carrying/deadly force, as I understand it, which basically means that there's not really anything the guy can do about it.

Cuz prosecuting real criminals takes "real work"... So the gor for the generally law abiding easy mark..
 
Texas CHL has an expiration date printed on it, so I think that will still determine when the license expires. I think the longer expiration date will come into effect the next time the license is renewed.
 
They didn't add 5 years to mine. I just received my renewal notice a couple of days ago.

Except prosecute you, anyway. The DA might lose on appeal, but he'll have cost you a bundle of money in legal fees.

DAs can't prosecute car carry. It isn't against the law now, that's the whole point of the new legislation. It isn't an offense, so you can't be indicted. If you were arrested for allegedly committing a fictional offense, then I would think the city would open itself up to massive litigation.

Maybe under the old law, with the "travelling" nonsense. This new one is pretty clear. You get arrested and prosecuted for this just bide your time and pay your legal fees. You can buy an airplane and a few hundred acres with the settlement money you'll get.

The Harris County DA has "shut the hell up" on this one as far as anyone can tell.

It's funny, his big runny mouth is what got this law changed. If he'd just kept quiet things would never have changed. We owe him a thank you I think :)

True, I never thought of that. :)
 
The new 10 years thing is that for and after the third renewal, you can opt to only take the CLASS every 10 years instead of every 5 years, but still must renew every five years.
