the BATF lost my check

I sent in my C&R application and a check for the $30 fee, today I got a letter saying that until they get the $30 they can't process mmy application. I called and the woman said I'm good to go she just needs to see payment. So I call my bank and the check has not been cashed. Has anyone else had the BATF lose there check? I know they got it since it was in the same envelop that my application was in. Is there a phone number to call where they recieve and process the checks? or am I going to have to mail out another check and hope they get this one? If I do and then they cash both will I be refunded the extra $30 I sent them?
 
I would call them and ask to speak with a supervisor. Tell them you have no problem sending out another check, but you want their assurance that they will only cash one of them, if they find the check. Be sure to record their name, time and date.

I'm sure you've done this but just in case... Have you asked them to flip thru the app again and see if it's still in there somewhere?
 
Paperclips (if you cant staple it) are a very good thing to use when dealing with the ATF.
The mail-room people seem to lose anything they can, it must be where Feinstein, Boxer, Schumer, etc get their kids government internships.

Staples work better, such is the reason the IRS has us use them.

Does it matter if the BATF has lost anyone else's check? Will that change your circumstance in any particular way. From the sounds of it, this is just one of those little clerical mistakes that sometimes happen.

Think about it. Have you ever known of another organization that receives payments that has ever lost checks? Sure, probably several. For your query here, it isn't even particularly relevant that this was by the BATF.

You can call somebody there, as with any other organization, and ask that they return/destroy/ or otherwise not cash the first check. Of course, how well do you expect that to be accomplished if they were not responsible enough to not lose it originally?

In the final bottom line analysis, by using a check and sending it through the mail (not hand delivered) as you did, you incur a certain risk. Your safety net on this deal is to call your bank as stop payment on that check. If your bank is like mine, that process will cost you $25.
 
Send them another and ask that they return/destroy the first one. Get the name/ID of who ever you talked to that said that they would. That said however leave enough money in your account to cover both checks as chances are they will find the check and deposit it anyway. Once they do then ask for a refund (or see if they can make it a six year C&R).

I wouldn't bother with the stop payment on such a (relatively) low amount. If you do place one you KNOW that you will be out the $25 (my bank is $29) no matter what while if you do nothing you will either have to jump through some hoops to get it back (if they cash both) or will still have an extra $30 in there every time that you balance your account for a few months until you decide that they really did lose it and spend it.

They will probably cash both (if they find the first one), and then send you a refund check. Thats how they handle Form1s from civilians for MGs, they cash the check upon reciept and issue a refund check when sending the denial letter out; they dont send the check back.

Contact your bank and tell them to put a "stop payment" on the original check #, then issue another. The only problem is that the bank will charge you a fee for this. My bank charges $25 for a stop payment, but it does insure that the check won't be cashed, ever.
 
That's the right answer. Yeah, their mistake cost you another $10-$25. Life is not fair.
 
Hmm, they cashed my check on 3 day from my mailing it out. Then, the C&R FFL arrived about 26 days later.

I wouldn't spend any money on cancelling the check. Keep an eye out for it being cashed by them, and then call them and tell them they owe you $30. Then, mail ATFE front and back copies of both checks for proof.
 
When I applied for my C&R they spelled my last name wrong!
I thought "oh no,here we go".Made the call and was pleasently
surprised how helpful they were.Had the new license in less
than a week!

Nutshell: License lasts for 3 years.

You can buy weapons that are classified by BATFE as Curio & Relics: 50 years old, or so designated (you'll see the list at Cruffler).

Handguns are shipped two day air direct to your house.
Long rifles can go slower.

Most of the weapons I own are C&R and they're awesome to shoot, especially a Yugo SKS or a Russian M44, for instance.

You can buy directly, but don't develop a pattern of sales. This is a collector's license, not a real FFL.

Another advantage is discounts from outfits like Brownells, MidwayUSA.

You can get the forms at the above site too. Print them out. Don't worry about page size. Make sure to fill out their latest form ? citizenship authentication or something (didn't have to do that myself).

If you've been a good boy, you should get your license in as few as 25-30 days.

Then, you make 25 or more copies, signing each individually in blue ink, and stowing the "unsigned" license away for safekeeping. There's a good C&R vendor list over at Gunsnet's C&R area. Mail one to every one on the list you choose, and don't forget Midway and Brownells.

You'll have to log in each purchase in a logbook (Brownells).

Then, be prepared to spend some money. It's a powerful feeling to be able to greet the UPS man delivering a gun to your own house.

That would be so much fun. My County Sheriff won't sign off on a Class III app though. :(

Got a buddy who has a Class III Mak, so at least I get the thrill once in a while.

This same county has its first in the state local income tax. Now, I have to file taxes with the IRS, State and the county. Just passed law will cause me to have to write a check to the county for the year 2003, as it's retro.

BOOM, here's a tax bill in January!!! That pisses me off more than the lack of ability to own Class III.

Think it's time to write the Sheriff a little letter telling him what I think about the Class III policy and his recent threats of releasing rapists and murderers into the population - lack of funds - if this new tax measure didn't pass. Perhaps I can weigh the argument heavily enough to help persuade him to change view on Class III.
 
I certainly hope BATFE don't loose any paperwork (a check); at our last ATF audit, twelve of my employees spent four hours sorting through boxes of files looking for one sheet of paper because the agent by law had a right to review it. If we could not produce the record we would have been in violation of ATF rules. I am certain they have equally high standards for themselves.:rolleyes:
 
I am very happy with the BATF. When I did my C&R FFL, they said it would take 4-6 weeks but I had my license in less then 3 weeks with no problems.

I don't think this is a scam to steal your $30. Just send them another check and don't bother canceling the first one because it will cost you $20-30 to do so. If they cash both checks, call them up and let them know what happened and they will refund you $30. If you cancel the first check, you can never get that money back.
