Legal overall length is measured with the stock extended. If those had a 16" barrel and an OAL of at least 26" with the stock extended, they weren't illegal. It doesn't matter if the stock was collapsed in the picture, all that matters is the extended length.
 
Overall Length of folding stock firearms. My M1 carbine in an M1A1 folding stock is less than 26" folded. ATF rule on non-detachable folding shoulder stock is OL is measured with the stock unfolded as a shoulder fired firearm.

If the shoulder stock is easily removed, that's another thing. When I followed the US Army/Air Force tech manual to inspect and adjust my folding stock to improve the lock open stability, that included disassembly and removal of the wire stock which involves tools. I removed the barreled action from the stock mostly because it was easier to work with the stock by itself but also because it would be SBR with the wire shoulder stock removed.
