Thoughts on magazines.

This might be nothing more than a fart in the wind... But I was wondering if anyone has thought to argue for creating nasty penalties for those using high capacity magazines while in commission of a crime, rather than banning high capacity mags used for lawful purposes? It couldn't possibly make crime worse than it is now and our rights are not infringed.

I'd be ok with double secret extra punishment for those who use standard cap magazines in the commission of a crime.

That said, I don't think it would have much effect on rampage shooters, since they generally check out as soon as anyone gives them even a modicum of resistance.

To be honest though, I think this would be a good idea.
After all, we know none of the proposed restrictions would prevent another massacre, so why not introduce this just to shut the antis up?

It would not affect any of us, since we aren't criminals.

Having said that, such a law would still paint standard cap mags in a negative light, and a ban would probably still follow.

1911 single stack is 6-10. My P01 holds 14. The SP01 is 18. FN 5-7 is 20. PMR-30 is...30.

So what is a 'hi-cap' mag?

I would be in favor of this as a smoke screen to redirect attention from a ban.

Instead of banning 'assault weapons' make using them in a crime a federal offense. it will make the antis feel better about themselves and not actually do anything except make sure those spree killers who do get caught get extra punishment.

A super duper penalty for using a hi-cap during a crime is about as useful as the super duper penalty for shooting first responders introduced into the NY SAFE Act. These types of rampage killers tend to not survive, and even if they did, I don't think an extra penalty on top of multiple life sentences is going to amount to much.

I'm not sure how often "high cap" magazines are used in crimes, but the initial idea sounds solid in targeting the types of criminals that might use these types of guns in non-rampage shooting events. It still won't have a perception of doing any good because the high-profile rampage killings are the only types of crimes that achieve that type of infamy. A bank robber with a Glock 17 and a "high cap" magazine won't be making national news when he gets an extra 10 years tacked onto his sentencing.

Bad juju. The .gov defines what a 'crime' is. Guy busts down door, woman grabs AR and shoots BG. State law states she must retreat first. She's not aware of this, gets hit with a crime. Now it's federal.

Since using a gun in the commission of a crime is already a crime, in and of itself, what does adding additional stipulations about the specifics of the gun gain? That's right up there with "hate crime".

Define 'high capacity magazine'.

Any mag holding more than a given gun is designed for. 33rnd mag in G17? High cap. Same mag in G18? Standard. Same goes for AR/Ak. 30rounds is the norm, drums are not. This is not an argument against "high cap mags" but if we are going to correct on 30 round AR mags as standard capacity...then >30 would rightfully be considerd high capacity.

What could we possibly add to the equation to get people to not use standard capacity magazines in the commission of a crime?

Castration?
