He's talking about the brief the Justice Department has filed in regards to Heller.

It's funny but just 2 years ago we were applauding then AG Ashcroft for a position paper he wrote/had written defining his offices belief that the Second Amendment was clearly an individual right.

Mukasey's been on the job what, a whole 2 months now? Lovely.
 
Is there a thread talking about the brief filed? What are we unhappy with about it? Pardon my ignorance. I'll be more than happy to put pen to paper (or more apt, type it up!) and send something to those relevant parties if I'm in agreement that the papers filed are somehow contrary to the 2nd Amendment being an individual right, etc.

Should we just talk about this thread solely in legal? I read that thread and downloaded the brief and am going to read it and would still consider writing President Bush and others involved. I feel like maybe writing the Supreme Court Justices could be helpful, though who knows how/when/if things you write to them actually make it to them personally. But a post in legal raised a good point that it doesn't matter what the White House or anyone else says as long as the Supreme Court Justices remember they're an independent branch of the government. In fact, it is the sole reason they were created to not follow suit with the others if they determined something to be Unconstitutional, etc.
 
I just wrote this up now, I would urge you guys not to use it quite yet until we all take a look at it and figure out if there are any spelling errors, poor sentences, or if I've made some sort of glaring error. Please provide feedback and maybe we can use this as a form letter with or without minor/major changes.

I initially was going to try to write it so it could be send to a bunch of people, but as it is now, it seems mostly geared towards the President. However I wouldn't mind writing up more forms for different agencies/people, but it would take time, as I'm at work. Thoughts?

In the recently field Amicus Curiae brief from the Department of Justice in regards to the upcoming Supreme Court case No. 07-290, District of Columba, et al., Petitioners v. Dick Anthony Heller I find the stance taken by the Department of Justice to be contrary to what the Second Amendment and the question therein raised actually represent.

I would urge you to help represent myself and the rest of the citizenry of the United States of America in doing everything possible to ensure that the outcome of the case District of Columbia, et al., Petitioners v. Dick Anthony Heller be found in support of the Constitution.

With this in mind, I humbly recommend that the Amicus Curiae brief be withdrawn or heavily amended to further support the Constitutional affirmation of the natural right represented in the Second Amendment of the United States Constitution. It should be left to the Supreme Court of the United States of America to find, without outside pressure from other agencies, including the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) what the true meaning of the Second Amendment to the Constitution means for the law abiding citizens of this great country.

Further, I would urge you to recommend to the Supreme Court of the United States of America to review the aforementioned case under the strictest of scrutinies to assure the affirmation of the natural right there included in the Constitution to all citizens.

Not to be a wet blanket here, but why would the Bush administration care? He's not up for re-election, your opinion doesn't matter to him. The only way to influence him now is through the party. And I don't even know if the party can do anything.

Sometimes I like to think just a few people writing letters can make a difference.
 
Here's what I sent to the RNC:

President Bush is not up for reelection, so to him, our voices are irrelevant. However, I intend to hold the RNC accountable at the ballot box for these anti-freedom briefs in the DC case. The RNC is the only organization which can influence Bush on policy matters now. These briefs are a stab in the back to Second Amendment advocates everywhere. Second Amendment advocates, by and large, form the most deeply loyal core of the Republican party. Though, one must ask how many times we may be stabbed in the back by what we consider "our own" before summarily abandoning the party wholesale at the polls.
 
Think anything much gets through the bureaucratic filters that surround him? In addition, Bush's orientation on firearms is not a secret, he told everyone he would sign a reauthorization of the Clinton Assault Weapons Ban if it got through The Congress, and he isn't running for re-election either.
 
I believe the first sentence should read "filed" not "field". (I do that all the time when typing fast.) Otherwise, pretty good letter.
 
As an aside, I have read about one-half of the brief. I have to say that SCOTUS rules, or the typist of this brief, do not follow the Paperwork Reduction Act guidelines. The printed text on each of the 35 pages of the brief covers less than 1/2 of each page. There is a nominal 2" border on each side, about a 1" border on the top, and several inches of border on the bottom. That is all wasted white space on the page that could have been covered in text. Now every person or entity that wants to copy this document has to waste at least half of the paper required for printing.

Our efficient government at work!!

Perhaps a lawyer on THR who is familiar with briefs could explain why the document was prepared with such wide margins.
