Ok, so I moved out of my house I have been in for the past 7 years and will move in to my new home on 1/17/2013. In the interim, I am renting a home 2 house up from my old one (lucky?).

I asked this question to an FFL, but would like more than one answer.

Do I need to go to the DMV and get a new DL that shows my current (for 27 days) address to do the transfer. Or can I just list my current address and not change my DL that shows my old address?

What say you all?

Why would you ask an FFL holder about your DL?

Many states allow a grace period for a change of address. Call your DMV office or check the states website.

Afaik, it's best if your 4473 address agrees with your DL address. Anything but that starts down the explaining part. Changing your DL to the temporary address seems like a lot of work only to have to change it again. I would either not do the 4473 or use the address on DL as it stands. I have yet to meet a gun that's worth a DMV line, twice.

Why would you ask an FFL holder about your DL?

Why do you think? I want the gun. My current address doesn't match my license. An FFL does transfers, ergo they have may knowledge of the law (ATF form 4473).

Does my current address have to be on my drivers license - which they copy.

Michigan puts a sticker with your new address on the back of your DL for free. Doesn't MO do this? Or do they actually issue a new DL?

Printed Page 136:

ATF has received questions from
licensees regarding purchasers who
present a State-issued driver's license
or other identification document that
shows either an out-of-date residence
address or a mailing address (such as
a post office box) in lieu of a residence
address. ATF has advised that
these identification documents, standing
alone, would not satisfy the requirements
of the regulations
implementing the Brady Act.

It is ATF's position that a combination
of documents may be used to
satisfy the Brady Act's requirement for
an identification document. The prospective
transferee must present at
least one valid document that meets
the statutory definition of an identification
document; i.e., it must bear the
transferee's name and photograph, it
must have been issued by a governmental
entity, and it must be of a type
intended or commonly accepted for
identification purposes. ATF recognizes,
however, that some valid government-
issued identification
documents do not include the bearer's
current residence address. Such an
identification document may be supplemented
with another valid government-
issued document that contains
the necessary information.

Thus, for example, a licensee may
accept a valid driver's license that
accurately reflects the purchaser's
name, date of birth, and photograph,
along with a vehicle registration issued
by the State indicating the transferee's
current address.

Bottom line - you need a document issued by a government that shows the residence address you put on the form 4473, which needs to be your current address of residence. If you lie on the form, and put your old address (as bikemutt seems to be suggesting, " I would either not do the 4473 or use the address on DL as it stands.") you would be committing perjury and a Federal felony.

It's totally stupid, because all that really matters is your state of residence, not where you reside in that state, but it is what it is.

I'm not sure on what you "have to do" but I know I would skip the interim house ad save the hassle.

By 1/17/2013 the firearm that the OP wants to buy is likely to be banned by the Federal government.

When in doubt......read the instructions in the 4473

When you complete the Form 4473 you are required to list your CURRENT residence address on Question 2. Write in anything else and you commit a Federal crime.

You will be required to show a valid, government issued, photo ID. If the ID does not show your current residence address then you must provide "alternate documentation" that the dealer will record on Question 20b.

This "alternate documentation" must be "government issued" and show your name and the CURRENT residence address.....it can be a traffic ticket, hunting license, tax document, utility bill from a municipality, etc.

Thank You NavyLCDR & dogtown tom.

As you said NavyLCDR -

This ^ is why I will do what I have to.

I have a month to month lease agreement (in case my new house falls through) with the current owner of the home I'm renting. I take this (lease agreement), which should be enough, to the DMV and get a new DL for the transfer next week and I'm GTG. Right?

dogtown tom, we are on the same page......but a FFL told me I didn't need to change my license....just list my current address. As I said in my OP, I wanted more than that one answer.

I would see about taking the lease agreement and getting a hunting or fishing license. Might be cheaper and easier than the driver's license and be just as valid as the additional proof of residence.

Looks like $7.00 to get it online and print it for a migratory bird hunting permit:

http://mdc.mo.gov/permits

If you don't have a hunter education certificate, then do the apprentice hunter license online for $11.00.

Looking further into it....Heritage Card for $3.00!

"Provides customer id information, and can also be used as verification of being hunter certified, if the hunter education number is printed on the card. This is NOT a permit. "

Went this morning and paid $13.00 for a new DL that shows my current address. No wait either......I think I'm GTG now.

There is one state that requires the driver's license to be a certain number of days old to be used for firearms purchases/transfers, but I am certain it isn't Missouri.

That came from an FFL who told me to either write down the address on my DL or go get a new license. I went and got the temp from DOL. Perhaps this underscores your point about the 3 worst purveyors of gun law information.

He must have responded to the wrong thread because it doesn't make sense.
I ment, use one address or the other . Don`t use both (don`t mix and match) Why compound a possible problem.
As like you and other posters ,it`s just my opinion. Reading the other posts, there are varing degrees of suggestions. I have no problem with what they say.
That`s my retort .sir. Hope that satisfys your, "......it doesn`t make sense." comment.
After reading your comment I though, I`m saying almost the same thing, although not in that much detail.
The the others who don`t understand, read the above.
Happy Holidays to all, even those who don`t understand.
