VA CCW holder stopped in WV...

Here's what happened, just FWI....

After the sheriff pulled me over, I informed him that I had a VA CCW and my gun was on me, what do you want me to do? I also chimed in as I handed him my license and CCW that my permit is good in WV.

Where is your gun, he asked.

In my bag on the passenger seat I said.

Take it out with your left hand and give it to me.

I complied.

He asked me if I had a round in the chamber (it's a Kahr K-9). I told him it's locked and loaded.

He removed the mag and cartridge and handed them to me, as well as the holster. Took the gun back to his car as he filled out his paperwork.

When he came back with my ticket, he handed me my gun and I was on my way.

This was the first time I was stopped by the law with my gun in the car. Pretty uneventful, I am glad to say!
 
Why did you do that? There's no requirement to notify an officer you are carrying, at least according to the packing.org page. Am I incorrect on this?

With all due respect to law enforcement, I think handing over your guns during a stop is a bad idea.
 
Did he hand you his gun, too?

Have to file this away for future use.

"Sir, I'm going to ask that you let me hold you pistol until I'm finished with your ticket."

He doesn't need to. It's very difficult and slow (even for a lefty) to use one's left hand to shoot through the driver's side window of a car while seated in the driver's seat.

Unlike some other threads re: LEO's recently, at least he knew how to clear the weapon. Good tactics on his part, though I'm surprised he bothered to disarm you. Must be eastern panhandle.

You're correct. There's no requirement here to notify an LEO you have a permit and are armed.

You need to call that punk and read him the riot act! No professional courtesy? If you weren't going 95 or over, you should've been let off just like someone from NJ would be.;)

He's a disgrace to the badge. Once you showed your permit, you should've been on your way. ;)

I was stopped just over the WV border on 522 in the Eastern Panhandle.

I couldn't remember if you're required to tell them you're armed in WV. So I went ahead and told him. My car is well-adorned with pro-gun stickers so I figured I'd avoid a hassle and just tell him.

That may well be the case, but I would still let the officer know. It's common courtesy. Of course some officers, such as this one, will behave poorly in response, just like some people will blow their nose in their hand and then want to shake hands with you.

I don't tell the cashier at the grocery store I have a concealed handgun. I don't tell the person manning the theater box office I have a concealed handgun. Why should I tell a police officer who is a complete stranger that I'm carrying if I don't have to?

Admittedly, in the vast majority of cases when a police officer is told of a CCW, they either don't care or are happy you have one. In this case, though, the officer was out of bounds IMO. Why on Earth would you need to carry the handgun with you while writing the ticket? Was he afraid you were going to storm out of the car and shoot him over what was likely a minor traffic citation?

EDIT: I looked at states like Louisiana and apparently you have to submit to a pat down and allow the officer to disarm you in some states. I suppose better safe than sorry when you don't know the law.

Why would he be? It's not like anything like that has ever happened before. :)

Reality is that he was out of line disarming you during the stop. I love the thought of asking him for his in exchage for the duration.
 
More than out of line

Lets take another look at ossifer friendlies actions. He demanded you surrender your firearm while you were exercising a fundamental civil right. His reasons for doing so? His Comfort and safety of course. He would have signifigant problems demonstrating a danger to his safety considering the law abiding record of ccw's. I suggest there should be a support group for leo's with a fear of ccw's.
Now our paragon of virtue and selflessness proceeds to manipulate your weapon. I'm sure glad he was completely familiar with your firearm. He was asking for a ND. Was your life insurance paid up? I'm sure his was.
Anyone here familiar with seizure rules? What was his justification for legally seizing your property? I would especially love to hear the answer to that last one. Inquiring minds want to know.
