The pro-illegals are trying everything they can to railroad Sgt. Haab. I think we need to start contacting our members o f congress or writing President Bush. Our enemies are not going to let uo at all.

Sgt. Patrick Haab, the U.S. Army reservist jailed for holding seven illegal aliens at gunpoint until Maricopa County, Arizona, sheriff's deputies arrived – and who was freed by that same county's district attorney after determining he had made a legal citizen's arrest – should have been prosecuted, say immigration rights activist and the U.S. Attorney's Office in Arizona.

The 24-year-old Haab was arrested and charged with seven counts of aggravated assault with a deadly weapon after drawing a pistol on a group of men he said charged him at an Interstate 8 rest stop. The men later were determined to be illegal aliens from Mexico.

After review of the charges, Maricopa County District Attorney Andrew Thomas determined that Haab's actions were legal under a Arizona law that authorizes citizens to make arrests if a felony or certain specified misdemeanors have been committed. The "coyote" smuggling the six other illegal immigrants committed a felony, Thomas said, as did his passengers who committed felonies when they conspired to illegally enter the U.S.


Thomas' legal reasoning, however, is being disputed by the Arizona office of the U.S. Attorney, who will only be prosecuting the smuggler on felony charges. Illegal entry to the U.S. is not a felony on the first incident nor one of the specified misdemeanors covered under Arizona's citizen's arrest law. None of the smuggler's illegal clients will be charged by the Feds.

"Individuals can't be charged with aiding and abetting their own smuggling," Sandy Raynor, public affairs officer for the U.S. Attorney's Office in Arizona, tells the Arizona Republic. "If the people being smuggled are only being transported, then there is no conspiracy. ... That is federal law."

"The only federal charge pending at this time is against the driver of the vehicle who is the alleged smuggler," adds Raynor.

Barnett Lotstein, special assistant to the Maricopa County attorney, defends his boss's decision not to prosecute and disputes the U.S. Attorney's interpretation of the law.

"When individuals by action agreed to be transported, or when they got into the vehicle to be transported, a crime of conspiracy was committed," Lotstein explains. "If they had never even gotten in the car, or had changed their minds ... they still would've been guilty of conspiracy."

Unlike police, who can only arrest when they have probable cause to believe a crime has been committed, citizens do not need probable cause – but they need to be right, or they can face prosecution after the fact.

Pointing a gun at someone without probable cause or the need for self-defense is a felony in Arizona, punishable by up to 15 years in prison.

Because conspiracy is a felony, Haab was covered by the citizen's arrest law, Thomas argues.

"If he had guessed wrong, he'd be prosecuted for a heck of a lot of offenses," Lotstein tells the East Valley Tribune. "He didn't beat the rap. He acted legally."

"That's not true," counters federal public defender Jon Sands of Thomas's charge of conspiracy to illegally enter the U.S. "Legally, that's just not the case."

According to Sands, immigrants who cross the border illegally usually become material witnesses against their smuggler.

Immigrant rights groups reacted angrily to Thomas' decision, holding a demonstration at the Maricopa County courthouse yesterday.

"The county attorney's decision will grant the license to hunt for Mexicans, or anyone with brown skin," Phoenix attorney Danny Ortega said. "We firmly and unequivocally believe that the decision was an abuse of discretion and of flawed legal reasoning."

Alfredo Gutierrez, former state senator and Spanish-language radio talk-show host weighed in on other immigrant-related issues facing Arizonans.

"This is the last hit," he told the crowd. "In the face of the Minutemen at the border (and) in the face of the pieces of legislation moving through the Legislature, to allow a citizen to pull a gun out because he was 'rushed' by Mexicans is an outrage."

"It is another notch in the disturbing pattern of impunity that vigilantes enjoy in Arizona," Border Action Network's Jen Allen told the Tucson Citizen, adding that his organization had prepared a complaint to be presented to the Organization of American States' Inter-American Commission on Human Rights next week in Washington

Excuse me, but don't the people who are smuggled into the country usually pay the smuggler to bring them into the country past the Border Patrol? And so you're trying to tell me that they bear no responsibility? :what:

Who is the US Attorney in that part of Arizona? I intend to write my congresscritters and the Whitehouse and demand his/her removal.

I'm sorry but unless they were kidnapped and brought across the border against their will, they did, in fact, engage in a criminal conspiracy to enter the country illegally. :banghead:

The way the illegal alien advocates are playing this one up, I think the above statement should be revised:

The US Attorney is an idiot. It sounds as though he is trying to say it is not illegal to sneak across the US border without any visa or entry permit. How did this numbskull ever get to the position he now holds?
 
In Colorado, a citizen has the same right to make an arrest a cop does...

you see,the smuggler was transporting zombies-innocent of all sin!
these poor zombies from south of the border didn't know they were being smuggled- the bad man simply herded them from the green pastures of Mexico,into his truck!

I've got a couple of questions about this:

1)Crossing the border anywhere except at a legal border crossing carries a $10,000 fine, correct?
2)This is a fine for a misdemeanor? :eek:
3)Or is this law only applied to US citizens? If so, I've got two points to make:1) :barf: 2) :barf:

The U.S. Attorney in Arizona takes what we think is a stupid position. He probably plans to run for an elected office in the future and this is nothing but political posturing to line up future Hispanic votes. If he tried to bring charges against the Sgt., that would be an entirely different matter.

This should tell us all we need to know. This guy is an idiot. If any group of people rush you, you are in a sure situation that warrants defending yourself. Maybe this Alfredo Gutierrez was confused and thought that it was a Mexican fraternity and the guy with the gun was a plebe that just wanted in. :D
 
I don't like to do warranty work, but I'll guarantee you this about the world you live in: If you survive an encounter with arms against some group, the survivors will lie like dogs to make you out as the bad guy.

That sergeant is lucky the liars didn't have a uniform story, per an earlier news release from the cops when they let him go. He's real lucky.

I know a guy who did hard time in Huntsville, after pulling trigger in self-defense. But, several of the Bad Guys lived through it, and 5:1 is bad odds on a witness stand...

This is not an illegal immigration issue.

If these dolts were citizens, they would still have committed assault and possibly other mayham crimes by charging 1 man!

Heck, he could have SHOT them in California if he had reason to belive he was about to face 'great physical harm'. 8 guys rushing me would seem to behove that fear...
 
The ACLU et al rode to the border expecting a target rich environment with all the beer-sucking, gun toting redneck Americans. After 3 weeks they got exactly nuttin'. They have got to get at least one scalp or their credibility is questioned. The SGT may well be the token redneck everyone's gunning for. :mad:

You're right. It is an outrage. You should pack up all of your illegals and go home in protest.
 
What you should take note in...

...is how the Fed via the U.S. Attorney's Office in Arizona, is taking a stand into this matter in the face of the local DA and state laws. Continually the FED and the White House are taking a stand against the majority (+70% by some samples) opinion of the US citizens on this issue of illegal immigration. Instead of bolstering support for themselves by making obvious moves to stop these migrations and smuggling (illicit trade), they very overtly snap back to make it difficult to stop - thus protecting it.

There's a lot of big business and big money at stake here, and it isn't what the US people want, but then there is no immediate pull like cash.
 
This one issue demonstrates the chasm between the ruling class and the taxpaying class. It bothers me because we are clearly watching the country being sacrificed at the altar of personal benefit. At some point there will be a flash and no one knows what will happen then.
