Can someone point me to the code references that point out the requirements a seller must meet to sell a handgun face to face in Virginia? I'm trying to purchase a pistol and the seller is nervous about violating the law. This is a private sale, I have a CHP...what do we need?

You need the money and the firearm. You will not find anything in the Virginia statutes regarding requirements of private sales of firearms because there isn't anything in there. You must be 18 years or older, residents of the same state, not be a convicted felon, under restraining order for domestic violence, convicted of domestic violence, or have been committed to a mental institution. These are Federal Law requirements for handguns.

No paperwork is required for the private sale within Virginia. If you want to write a bill of sale, that is fine, it can be anything so long as it is signed...

I, Joe Seller, did sell on April 1, 2008 one S&W Model XXX, Serial # XXX to Joy Buyer and did receive $XXXX. Signed Joe Seller. He gives that one to you as a receipt for your money.

I, Joe Buyer, did purchase on April 1, 2008 one S&W Model XXX, Serial #XXX from Joe Buyer for the amount of $XXX and received said firearm. Signed Joe Buyer. You sign that one and give it to the buyer for a receipt for his gun.

Actually, I was wrong, you will find it here:

look down toward the bottom:
2. The provisions of this subsection shall not apply to:

i. A person who purchases a handgun in a private sale. For purposes of this subdivision, a private sale means purchase from a person who makes occasional sales, exchanges or purchases of firearms for the enhancement of a personal collection of curios or relics as herein defined, or who sells all or part of such collection of curios and relics; or

The only other thing to consider is that if the person is military stationed in Virginia, you can sell them a handgun but should ask to see their military ID and a copy of their stationing orders.

Gentlemen, thank you, that is what I needed. I'm trying to buy a Sphinx AT380M, and the seller wants to be careful...nothing wrong with that.
