I am confused about carry in state parks. Can you carry there when they have a license to serve alcohol? According to the followng site they have a license http://www.virginia1774.org/ABCLicense001.jpg.

Isn't it against the law to carry concealed in a restaurant that has a license to serve alcohol? Is open carry ok there?
 
According to the regulation, you can only carry concealed, so how does a person carry at this state park restaurant I guess is what I am asking?:confused:

Just to clarify, when you say "According to the regulation, you can only carry concealed...", what regulation are you referencing?

No, you cannot carry into a restaraunt that serves alcohol. I'm pretty sure you can carry in state parks. In fact, with the loonies running around out there, i'd recommend it.

Not true. You may not carry CONCEALED in an establishment with a license for on-premesis alcohol consumption, however you may carry OPENLY if it is otherwise legal for you to do so (over 18, not a felon, etc.)

Also, I believe you may only carry concealed in a state park, not openly, but I'm not as sure about that one. I'm sure someone here has the link to relevant code on that issue.

The point is, how does one carry in an alcohol-serving restaurant in a state park? I have no idea.

Here is the regulation:


4VAC5-30-200. Firearms.

No person except employees, police officers, or officers of the department shall carry or possess firearms of any description, or airguns, within the park. This regulation shall not apply in areas designated for hunting by the Department of Conservation and Recreation. This regulation also shall not apply to the carrying of concealed handguns within state parks by holders of a valid concealed handgun permit issued pursuant to §18.2-308 of the Code of Virginia.
 
I just moved here to VA, so I'm rather curious about this myself. Seems like a Catch-22. The only way to legally carry within a VA state park is concealed, with a valid permit. The only way to legally carry in a VA permitted alcohol-serving establishment is openly. Thus, in an alcohol-serving restaurant which is part of a VA state park, except for "employees, police officers, or officers of the department", one may not carry either openly or concealed.

Not good if true. Anyone know if this is the case, or if there's some other exception or controlling law which gets around this?

Get acquaianted with VCDL - www.vcdl.org and call them, the VA AG's office or the state police. It all sounds like a Catch 22 situation. and I would \n't carry there until I had some clarity
