Legislative Update from Olympia 21 February 2003

THERE WAS NO GOAL POST DISTRIBUTED ON 14 FEBRUARY WHILE I WAS AT THE SHOOTING, HUNTING, OUTDOOR TRADES (SHOT) SHOW IN ORLANDO.

Three additional gun bills have been filed in the past two weeks. HB 1810 is the House counterpart to SB 5083, the CPL reciprocity bill. SB 5847 would require retail gun shops to install WSP-approved electronic anti-theft devices. SB 5910 is a Senate counterpart to HB 1657, the range and instructor protection bill.

There are no public hearings scheduled on gun-related bills in the coming week (and there were none last week). Committee cut-off (last day to pass a bill from its original committee) is March 5th. While a decision to move this bill and ignore that one is complex, the simplest explanation for the lack of movement on gun bills—pro or con—is simple: pro-gun bills that pass the Senate will get stopped in the Democrat-controlled House, and anti-gun bills passing out of the House would stall in the Republican-controlled Senate.

Should an incident occur that gives impetus to a particular bill, a public hearing can be scheduled within 24 hours—or even waived. If I find any “surprises†in the daily schedule (published the evening before), I will distribute a GOAL Alert. The media occasionally pushes for specific legislation, such as the Seattle P-I did for SBs 5316 and

I try to keep the GOAL Post non-partisan, as there are several pro-gun Democrats in the legislature, as well as some anti-gun Republicans. A look at who sponsors or co-sponsors a given bill tells the tale. With 2/3 of the process (the House and the Governor’s mansion) in Democrat hands, the likelihood of a pro-gun bill passing into law is unlikely.

An exception to this is a case where broad bi-partisan support exists for a bill. This may be the case with SB 5083 (CPL reciprocity), which passed out of committee with all five Republicans and three of four Democrat committee members voting “aye.†There is a good chance that will pass out of the Senate with several Democrat votes, a signal to the House and to the Governor that maybe, just maybe, this is one that deserves full passage.

ACTION REQUIRED: Please call or e-mail the members of the Senate Rules Committee listed below and ask them to pass SB 5083 out of Rules to the Senate floor. This bill received strong bi-partisan support in the Senate Judiciary Committee and deserves a vote of the full Senate.

SB 5083 Grants reciprocal carry privileges to those states who recognize Washington CPLs. Counterpart to HB 1810.

SB 5315 Establishes a ballistic imaging data base with the state patrol and requires firearm dealers to provide a sample case and projectile for all new handguns sold.

SB 5316 Requires all firearm transfers at gun shows to be processed through a federal firearms licensee. Counterpart to HB 1321.

SB 5317 Makes leaving a loaded firearm where a juvenile under age 16 may access it a gross misdemeanor. Counterpart to HB 1791.

SB 5847 Requires licensed gun dealers to install electronic anti-theft devices in their shops. Devices must be approved by the WA State Patrol. Average cost is estimated to be $3,000 or more, driving a final nail in the coffin of many smaller “mom and pop†gun shops.

SB 5910 Prohibits certain lawsuits against gun ranges and gun safety instructors. Counterpart to HB 1657.

HB 1319 Prohibits lawsuits against gun manufacturers for lawful products that function as designed; also restates preemption.

HB 1321 Requires all firearm transfers at gun shows to be processed through a federal firearms licensee. Counterpart to SB 5316.

HB 1657 Prohibits certain lawsuits against gun ranges and gun safety instructors. Counterpart to SB 5910.

HB 1665 Exempts police officers from the requirement to surrender firearms when subject to a temporary restraining order.
