SB 5910 (RANGE PROTECTION) PASSES SENATE JUDICIARY

COMMITTEE CUT-OFF PASSES; MOST GUN BILLS DIE

ANTI-TERRORISM BILL MAY TURN ANTI-GUN


SB 5910 (range protection) passed out of the Senate Judiciary committee on a 7-2 vote just before last Wednesday’s committee cut-off. Before it passed from committee, three amendments were offered that would have gutted the bill. The first two failed, but the third, stripping out instructor liability protection language, passed. While this is disappointing, the core intent of the bill—shooting range protection—remains intact. It now sits in Senate Rules awaiting a pull to the Senate floor for passage from the Senate. At a Friends of the NRA (FoNRA) banquet/auction Saturday evening, Senate Rules committee member Senator Marilyn Rasmussen (D-2nd) promised she would pull the bill from Rules.

Bills that had not passed from their original policy committee by 5 p.m. last Wednesday are considered “dead†for the session. However (there’s ALWAYS a however), an exception to policy could be made under certain circumstances. Another “dirty trick†used is to attach a dead bill to an existing bill as an amendment. Under our state constitution, bills are limited to a single subject, and a narrow subject on a bill is supposed to preclude such games.

All anti-gun bills officially died in committee last week. Range protection (SB 5910) and CPL reciprocity (SB 5083) are still alive and moving through the system.

Wednesday, March 19th, is chamber cut-off, the day that surviving bills must pass out of their original chamber (House or Senate). SB 5083 is now sitting in the House, awaiting action after chamber cut-off; SB 5910 still needs to be passed by the full Senate.

The House is getting ready to pass an anti-terrorism bill that normally would not excite much attention on a pure gun-related basis. Among other things, the bill defines “weapons of mass destruction†(WMD) and imposes extra penalties for using or threatening to use same. Rep. Jeannie Darneille (D-27th) is offering an amendment that would add “firearms†to the definition of WMD. This is exceptionally insidious, as this would
then be used to put the “anti-terrorism†label on every gun control bill that comes along. Rep. Jim Buck (R-24th), one of the bill’s original sponsors, has an amendment that clarifies WMD in the traditional sense:
chemical, biological, radiological or nuclear devices. A separate action alert will be published on this.

SB 5083 Grants reciprocal carry privileges to those states who recognize Washington CPLs. Counterpart to HB 1810.

SB 5315 Establishes a ballistic imaging data base with the state patrol and requires firearm dealers to provide a sample case and projectile for all new handguns sold.

SB 5316 Requires all firearm transfers at gun shows to be processed through a federal firearms licensee. Counterpart to HB 1321.

SB 5317 Makes leaving a loaded firearm where a juvenile under age 16 may access it a gross misdemeanor. Counterpart to HB 1791.

SB 5847 Requires licensed gun dealers to install electronic anti-theft devices in their shops. Devices must be approved by the WA State Patrol. Average cost is estimated to be $3,000 or more, driving a final nail in the coffin of many smaller “mom and pop†gun shops. Counterpart to HB 2074.

SB 5910 Prohibits certain lawsuits against gun ranges and gun safety instructors. Counterpart to HB 1657.

HB 1319 Prohibits lawsuits against gun manufacturers for lawful products that function as designed; also restates preemption.

HB 1321 Requires all firearm transfers at gun shows to be processed through a federal firearms licensee. Counterpart to SB 5316.

That is some great data...too bad the Legislation Protection bills died ...have to try again next time, I guess.:(
