My BIL and I both want to purchase a Mosin Nagant from the same online store. A local dealer charges $20.00 for the first transfer and $5.00 for additional items. I was thinking ordering both guns to save on shipping and transfers and just let him pay me for his half. Just wanted to make sure this is legal. Both of us may legally own and purchase firearms, and have not exceeded any local limits on purchases lately.

Are you the actual purchaser of the gun? If he is paying you for his half, then the answer is probably no and you would be lying on the Form 4473.

No I would not be the actual purchaser of one of the guns. Thank you it's not worth saving a few dollars, I just wanted to make sure.

Straw purchase. Go to jail for lying on your 4473.

Question 11a on the 4473 asks:
Are you the actual transferee/buyer of the firearm? Warning: You are not the actual buyer if you are acquiring the firearm(s) on behalf of another person...

As one of those firearms is intended for your brother you cannot truthfully answer that question with a YES.

Asked and answered. I'm closing this one as we have several other threads running right now on what is and isn't a "straw man purchase."

An addition, thanks to CoMoRo:

They could order the guns together to save on shipping, but have them individually transferred at their FFL. Each guy fills out his own 4473 and it is not a straw purchase.
