In reasoning the middle east out, it helps to try to think like a middle-easterner. There, the concept of nationality is very weak, while the concept of unity by religion is much stronger. Indeed, there are lots of people that the various governments refer to as "stateless arabs".
If Saddam wished to use a nuke against the US, and avoid the consequences, he would provide it to a team with passports from <insert country here> and send them off. They detonate their bomb in an American city, and Muslims all over the world throw their turbans in the air, knowing that there's no direct connection to any Muslim state. Saddam never admits it's his, but joins the chorus, warning the US to stay out of the middle east. I would expect it would take quite a while to trace the device to a particular country, and of course, everybody over there would soon be warning us that there are an undisclosed number of nukes in undisclosed locations, and if we know what's good for us, we'll begin converting to Islam right away.
 
That is just my point. Saddam is not insane, an insane man could have easily used such weapons against US troops. The fact that he did not, shows he responds to real threats against himself and his nation.
