West Virginia/North Carolina Reciprocity Question. Please Help

Hey folks, I know that I have started a few threads on the subject but I still cannot find an answer. I have a valid West Virginia Concealed Pistol License and am moving to North Carolina as an out-of-state student. My question is can I legally carry in North Carolina? I will by renting my own apartment (not on campus).

I have called the Attorney General's office, who was less than helpful. The told me to call the issuing department in WV to make sure my license would still be valid (State Police said as long as I'm a resident of WV (WV Driver's license, paying taxes to WV, ect) it's valid). They didn't mention being an out of state student. So, I called the Charlotte PD who referred me to the Sheriff's Department. SD did not have an updated list that WV and NC had reciprocity. :banghead: I had to look on the NCDOJ website to tell her that we did. She said that reciprocity is normally for traveling purposes and wasn't sure about being an out of state student.

So my question once again is could I legally carry a concealed pistol in NC.

I would say that you cannot. If your renting and getting mail/bills to your apartment then you would be a resident of NC. If you plan to be there for the 4 years why don't you just change everything over and get a NC permit?

That would be North Carolina would it not? I believe that NC requires someone to be a resident for 6 months prior to applying and the process takes 90 days - the fee is $90 and you must have passed a concealed carry class which will cost you another $50 or so.

I am not certain, but have heard that West Virginia has recently agreed to reciprocity with NC but have not confirmed that. I do not think where you receive your mail changes your state of residence - I know it does not for the military personnel. I would suspect that your drivers license, your auto registration and where you pay taxes and vote would be the main criteria, but I could easily be wrong. My wife says I am always wrong!!

I would suggest you contact West Virginia to determine the status of residents attending out of state schools. I believe that would be a start.

Good luck and by all means get your permit straight - if you live in the Charlotte area you just might need it.

As a student you can keep your WV Recidency and your WV permit is valid. As long as you have a WV drivers license and if you have a car and the car is in your name and has WV plates and you pay taxes in WV you are a resident of WV. The permit is good. If you give up your WV drivers license your permit is voided at that moment and is susposed to be returned to the Sheriff who issued it.
 
You can also get an non-resident permit from FL which is recognized in NC. This is how resident aliens in KY can get around the new U.S. citizen requirement for concealed carry.
If you can't get what you're looking for from someone in an appropriate position of authority in writing (might try the AG), the non-resident permit removes all doubt of your status to legalley carry concealed.

WV State Police (the issuing authority) confirmed that we do have reciprocity with North Carolina.

That's what I was originally planning on doing, but Florida doesn't have reciprocity with West Virginia at this time. Also, money is kind of tight for my at the moment(tuition) so it isn't really an option.

That's what i thought as well. I was looking to see how North Carolina would handle an out of state student's permit. My idea was that I have no plans on staying in NC once done with school (at the moment) so I would be 'passing through' the state for an extended period of time. :confused: Does that even make sense to anyone else?
