I am a New York State resident and I am planning on moving to North Carolina. I possess an Unrestricted(CCW) permit in New York. I am looking to bring my handguns with me to North Carolina. I am wondering if anyone knows how I would go about transporting(I am driving) my guns and what do I do once I get there? I am familiar with North Carolina gun laws but I am unclear about transfering guns from one state to another. Is this a federal matter? Any help would be greatly appreciated.

NY is one of the exceptionally restrictive states, NC is not although it does appear to have some quirks. There are several web sites that will give a summary of state's gun laws. Don't take legal advice from me or a web site, check things out for yourself and consult an attorney if in doubt.

That being said, here's what most of us law-abiding U.S. citizens do when we move. In-state, out-of-state doesn't much matter (except moving to NY, IL, MA, perhaps)....

How to transport your guns?
Pack them up in an unloaded condition and put them in your car, preferably in the trunk. Keep the ammo in a separate box. Drive to your new destination.

What to do once you get there?
Carry them in the house, unpack them and put them away. End of story.

AFAIK, you just take your guns and move to North Carolina - notifying the Feds or anyone else is not required. It may be a good idea to keep them locked in your car's trunk during the trip, in case you were to be pulled over by the police or involved in a traffic mishap (of course, you'll keep one concealed and at the ready during the trip).

You will have to check to find out if NC honors NY gun permits - I don't know, but I would expect that they do.

NC does not have any reciprocity with NY since NY does not recognize any other states permits. That by the way is one of the reasons I want out of New York. Not to mention the complete lack of jobs. Thanks for the advice.

NY licenses outside of NYC are for life. Do you have to give it up if you leave the state?

I had an assult pistol

whilst still a kali inmate (citizen, not behind bars); I got my prepaid mailer & DOJ letter stating I HAD to ship it back to Walther (Smith & W) to have the barrel nut supersuperglued onto the barrel, thereby making it a non-assult weapon (per kali DOJ, even though they approve it first-long story-do search) Anyway, I moved it out of state prior to the date I was to have it Kalizied by S&W, sent them back a letter stating it was no longer in kali, and that was that. Now I still have a P-22 that I can legally install a silencer on (per AFT regs)

I suggest disassembling your guns so that they are nowhere near functional and storing your ammo in a locked container separate from them.

Drive as fast as you can obeying the speed limit. Stop only to get gas.

When you reach your destination, assemble guns and ammuntion. NC is a free state, so once you get inside your domicile you should at least be safe. Sort out the CCW rules later. Just get the heck away from NY and do not pass go! Let the criminals deal with NY gun laws :D Don't see them posting here!

Rifles, shotguns and handguns (other than your carry piece) should be unloaded, cased and in the trunk. When traveling through a state that doesn't honor one of your carry permits, your carry piece gets unloaded, cased and put in the trunk.

Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver’s compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.

Good point. Destructive devices, short-barreled rifles and short-barreled shotguns also require a Form 5320.20.

I was in the same boat as you. A little over a year ago I moved from NY to Virginia.

I called the sherriffs department (ALL pistols are registered on your permit in NY) and asked what should I do.

He told me to have the pistols legally removed from my permit, I need to give them to a dealer in NY, have him write up the reciepts saying he took possesion of them, bring them to the office and have them taken off my permit and surrender my permit. The NY dealer would then have to transfer my pistols to a dealer down in VA where I could pick them up.

I said "Thank you" and just moved with them anyways. It would have cost me an outrageous amount of transfer fees and shipping to do all that. The permit system isn't even computerized, so unless they go looking for my specific permit for some reason, then they will never know. Hell...I'm sure there are probably thousands of dead people with their permits still on file.

Disclaimer: Technically doing this will make you a felon in NY for not notifying them that you moved within a week of moving. I'm never moving back to NY again so I'm not worried about it.
