What will happen to NICS if Federal Shutdown?

That's a darn good question. Never thought about it...

At least if there is a shutdown it won't last too long (well, hopefully).

I don't know.... the automated computer system might still work? This has the potential to kill some LGS

Worst case scenario is that the shutdown will last a few days. Just put any guns you might want to buy on layaway for that length of time.

NICS, I don't know. But I recently sent in my tax return. I guess my refund will be delayed. I know I should have sent it in earlier, but I always wait so I don't spend the money too soon.

I wonder what will happen regarding National Forests. Will rangers still be there? Without rangers, will they be shut down? National Parks will be closed, but they have strict gun rules, so I don't care. National Forests on the other hand...

NPR was claiming that national parks would shut down on Saturday if a deal isn't reached.

We won't know until it happens since the "assurance" from the fedgov is that essential services will continue.

My state has their own system in place of NICS so it won't be affected unless there's an extended services furlough.

It's interesting that you should bring that up. If NICS DID shut down, that could be grounds for a major lawsuit since it is a de facto suspension of Second Amendment rights. NOT designating it as an essential service would mean not upholding the US Constitution. It would be very difficult for the government to defend against the claim that it would not, under the Constitution, have to be an essential service.

I probably ought to actually look up the law, but doesn't it state that if a denial doesn't come back weithin five business days that the sale must go through?

Have you ever thought that be delaying sending in your taxes and delaying your refund you are providing the US Government with a 0% loan of your money?

Totally off topic and hi-jacking, I know.....

I'll bet NICS shuts down, except for purchases of firearms made by the legislators who shut it down. And they will still have thier paychecks in their bank accounts on time to have money to buy guns with.

Yes this is true. It's actually three days but it always ends up being five in everyone's mind. The day you are trying to by the gun doesn't count. Then three days pass, then you can pick up the gun on the day after your third day. Generally totaling 5 days.

3 days, but NICS working days, so if NICS isn't working......???

I've seen no direction from BATFE. I think NICS is out of their hands anyway.

Tell you what, I'll run over to Wally world right quick and check, hehehehe. I was thinking more along the lines of ... No fed=no fed laws=no 200 stamp for a thompson, hahaha, hopefully they'll be back up and running before I have to worry about that. I just found out this morning (don't watch the news) from my wife in afghanistan. Aparently, this is the last day they get paid for until the situation resolves itself. Darn shame.

I'm very interested in this seeing as how I'm in the market for a new pistol (aren't we all?)

I think if the government "shuts down" tonight, someone who always has no problems needs to test the NICS thing tomorrow. I have hit my gun buying quota for the time being. No purchases here in the next month.

After 3 days the FFL "may" proceed but does not have to. Its up the the individual FFL

There is no such thing as a shut down, it's a slow down.

The Department of Justice, which includes the ATF, FBI, BOP, ICE, Marshal Service, and a few other agencies will continue to operate as normal.

Still, wish I was in the market for a new gun right now. Due to other more prudent disasters, I can't afford a new baby for the family.

Feel free to send me some money and I'll get right on that

FOUND ON ANOTHER FORUM asking the same thing:

Just got this from the good folks at the FBI:

The NICS will be operating with a limited staff if a furlough takes place. The staff will be handling all incoming calls and working NICS transactions in the event of a furlough.
