why cant an ar15 RIFLE lower be bought out of state

Hello all

I live in kentucky and went to a gun shop in indiana to buy a ar15 RIFLE lower
and I was told I couldnt buy it even though it was called in as a RIFLE lower.

My question is why cant I buy a RIFLE lower out of state?
It perfectly legal for me to buy long guns in indiana all day long but the ATF turns down a ar15 RIFLE lower.

Does anyone know of a good reason why?
 
Did you fill out the form 4473 and get denied? Or did the gun store tell you they could not sell an AR-15 lower to an out of stater?
 
IIRC federal law alows a rifle or a shotgun to be transfered to an out of state resident. An AR15 lower is niether, it is transfered as "other" on a 4473.
 
Alland has it right. An out of state resident may only purchase a rifle or shotgun, a reciever (even if it could only be assembled as a rifle) is neither a rifle or shotgun, so can't be transferred. Same applies to shotguns with only a pistol grip.

If you can bear it, sit and read the NFA 1934 sometime. Nevermind the unconstitutionality of it; the AR-15's modularity makes all of the pistol/SBR/rifle nonsense into... nonsense.
 
I tried to buy a shotgun over a decade ago... I put it on layaway, moved out of state and got another driver license, and when I went back to pick it up, they told me they couldn't sell it to me because I had an out of state driver license. This was in AL and my license was from TN.

On the other hand, had I not been a US citizen and came here illegaly, they probably would have offered to carry it to my truck for me!
 
An AR15 stripped lower, or lower without a buttstock is not a rifle, nor a pistol anymore. It can be made into either form, and thus has to be transferred as an "other". So, if it actually WAS an AR15 Lower, they COULD. However, odds are, it wasn't. So they can't.

I totally agree with this above statement

I have never understood this law ... we are us citizens .... well at least most of us ...... so why do state line seperate us so much when it comes to firearms
 
There's a LOT of BS laws we have to deal with that many believe violate the 2nd Amendment...asking why it's there is a waste of breath. Just write your congresspeople, and join in trying to repeal as much as you can when ya can, but stay within the law while you do.

In Section 8:
Constitution of the United States said:
The Congress shall have the Power...To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes


It doesn't void the Second Amendment, but it does give Congress the power to regulate trade. The current laws don't prevent you from buying what you want in your own state, but Congress is within its rights to regulate sales between states.

If you want to defend the Second Amendment, you need to read the rest of the document as well. ;-)
