Gunmen barged into a North Side house early Wednesday morning, fatally shooting a 38-year-old man in his living room, police said.

Gary Osborne and his girlfriend were asleep in their house in the 3300 block of Stoney Star, when at least two people knocked on their front door around 1 a.m., said a San Antonio Police Department spokesman.

According to a police report, Osborne told his visitors that they were asleep and asked them to come back later. He went back to bed, then several minutes later, he heard someone kick in his front door, said Sgt. Gabe Trevino.

“He grabbed a baseball bat and she hid in the closet, and then she heard gunshots,” Trevino said.

Osborne was shot several times, including once in the head, and died immediately, the spokesman said. His girlfriend crawled out of a window in the back of the home when she heard the shots and called 9-1-1, Trevino said. She was not injured.

He said while investigating the shooting, police found several marijuana plants growing inside the house, leading them to believe drugs may have played a role in the murder. The house is near McAllister Park in the Ridgestone subdivision.

Police didn't release a description of the suspects or the vehicle seen leaving the home.

All though since he was a dealer I doubt that he could have a firearm. But good example if you don't notice the drug dealing part...

How does being a cannabis cultivator preclude him from having a firearm?

Unless he had been convicted of a previous felony, his legal right to purchase a firearm would not have been restricted.

He likely would have been breaking a law by possessing a firearm while in commission of the "crime" of possession of pot - but he'd have been better off alive and facing those charges rather than the alternative of being dead.

As has been said numerous times, stay away from the world of drugs and your odds are far more favorable.

Home defense and firearms? Why preach to the choir? That's actually rather an insult, given that this is a firearms website, frequented by firearms owners.
