Woman Cited After Saving Dog From Gator

In Florida there was another alligator attack. This time a gator came onto the porch of a house and attacked a golden retriever. When the owner saw what was happening, she shot the gator. The government "rewards" her for protecting her property by citing her for hunting out of season. BTW, the woman is an ex-marine.
 
Are these Aligators a protected species? And do these attacks occur in the direct vicinity of the main habitat for these animals?

I ask because a few years back there were a few bear attacks up here (PA, NJ, NY) which were caused by development encroaching on the lands of these animals.
 
We had a case a few years ago when a man going
squirrel hunting was asked to put a deer out of its
misery. The deer had been hit by a car, had broken
bones jutting from torn flesh and was obviously a
goner, dying in agony. He shot the deer and
humanely ended its suffering.

No good deed goes unpunished.

He was charged with hunting deer without a license.
Using ammunition illegal for deer (#6 squirrel shot).
They went down the book like Hal 9000 robots on the guy.

There was a public outcry and commonsense prevailed.
The rule of law needs to be tempered by the spirit of justice.
 
Deer auto collisions

Here in Iowa deer auto collisions are all too common. I had a doe jump out and hit my passenger door and she was not instantly killed. It's absolutely positively highly illegal to shoot a deer in such circumstances. I was later advised to brain it with a tire iron and what's one more dent on a well dented deer?
 
Generally, defending yourself, another person, or a domesticated animal from a predator is not "hunting."
 
I related this story over on TFL a while back, in a different context, but here goes...


I had come home from work one spring afternoon, and took my two children out into our front yard to play some ball with some other neighborhood kids.

I am sitting on the porch watching the kids, when I hear a child screaming loudly from across the street. I look over and see this child being shaken like a rag doll by a pit bull terrier that was firmly attached to his thigh.

I ran across the street and , after much kicking and punching, "persuaded" the dog to release his grip on the boy. the dog then lunges at ME !

I reached into my SOB holster and pulled out my Mil-Spec, and put a single tap into the dog's skull.

I secured and re-holstered my weapon, and began giving first-aid to the boy.

Seconds later the place is covered with LEO's and I am at gunpoint, and ordered to the ground where I am searched, and cuffed felony stop style.

after being launched onto the hood of a patrol car, searched again, I then get to sit in the back of said cruiser until my wife, and other neighbors tell the story.

After being Un-Cuffed, the nice officer issues me a citation for unlawful discharge of a firearm (City Ordainance)
and gives me back my weapon and my CWP.

No good deed goes un-punished

So what was the end result did you contest the citation in court, or was it like a $25 fine and you just paid it???

What city is this??

^^^simply amazing.

Next time you should just stand there and let the dog maul you...what's the point of having a CWP if not to use it in a life threatening situation as you apparently did. Perhaps the citing officer had a better idea for you to keep from being possibly killed?

These stories can cut both ways.

Here in Iowa moose are seldom seen, but when was, some guy shot it and then claimed self defence, the moose "charged" him. The DNR didn't buy it since the hole was in the wrong end of the moose. (Maybe it was a potentially lethal gas attack?)
 
I Live in a suburban town just east of Nashville TN.

and the fine was $100.00, I paid it rather than go to court, did not want one of our fine judiciary folks to get a chance at taking my CWP:cuss:

A "protected" species' protection ends when it encroaches on my front porch and attacks one of my family members, myself, or one of my pets. An alligator who would come onto a front porch and attack a dog has become so acclimated to human presence, and associates that presence with food to such a strong degree that sooner or later, a human tragedy is going to result.

Here, 'gators are so numerous that a hunting season has been intitated across the state line about fifteen miles away. I have no problems with one living in peace nearby, but if one finds himself on my porch chewing on my dog, I'll take whatever they want to throw at me. That 'gator is GOING to die.

If he is in my yard and causing no immediate threat, I'd just call the Department of Fish and Wildlife, who would then come and get the beast. Under four feet, and they relocate them. Over four feet, and they are put down.

As to "encroachment on the lands of the animals", I have yet to see a deed made out to a bear, mountain lion, or alligator. No matter where you live in this country, you are "encroaching" on the former living grounds of some animal or other.

I don't enjoy jury duty, but I hope my next case is one like this.

"Hunting" ? Who could anybody possibly construe this as hunting ?

Bradenton woman shoots alligator

BRADENTON, Florida (AP) — The alligator was only three feet long, but a Bradenton woman says she wasn't taking any chances.

When the reptile came into the lanai of her home Saturday and attacked her golden retriever, Candy Frey went and got her gun.

After Frey and her daughter managed to push the gator out of the lanai through the dog door, she blasted away at it four times.

A neighbor called deputies and a wildlife officer was sent to investigate.

Frey says the alligator barely bled from gunshots to its neck and shoulder. The wildlife officer put it back in the lake.

Frey was given a warning citation for hunting without a license.

Alligators have been blamed for three fatal attacks in the span of a week in other parts of Florida.

I can't stress enough that with an animal attack that doesn't result in injury to a human serious enough to require a hospital you MUST remember the 3S's.

Shoot.
Shovel.
Shut Up.
 
What would have happened to her if a University of Florida Gator was trying to do her harm and she shot him?

I know it is a pissy situation but that's government for ya.

I would like to see a process where if a gov employee acts in a way that is devoid of common sense that person is publically humiliated and then fired.

Citing her really pi**es me off. This lady was protecting a beloved pet NOT (by definition) "hunting". This to me would be like charging someone that shoots at a home intruder with illegally discharging a firearm within city limits.

Also, there was a woman a few days later that was held hostage (couldn't leave her house) by a gator. A responding Sheriff's Deputy shot the gator in the head with a .223 which only made the gator mad. It took a professional gator trapper to catch and remove that gator.

These incidents came after a single week in which 3 people were attacked and killed by different alligators. In the aftermath of such attacks you would think that the officer that cited this poor lady would have some understanding and not try to punish her for defending herself and her dog.

One reason that I think this upsets me so much is that I live here in Florida (Gainesville/Daytona Beach) and we are famous for a "sensible" gun laws. It is completely assinine to punish someone for defending herself or her beloved pet. Especially when there has been a recent plague of such attacks.

It is rediculous when you are required to call the governmanet (local, state, or fed) to send someone to defend you and your property. Here in Florida we just recently extended the Castle Doctrine to public areas demonstrating we Floridians believe in "self" defense not reliance on authority figures. :fire: [Rant Off]
