Apparently, the case could be a bench trial without a jury. How would that be determined; would the prosecutor need to agree to that? How about the defense?
 
Alaska444 -- If Martin reached for Martin's gun and could have used it against him, the second degree murder case will fall apart. In that case, the disparity of force issues are moot. If Zimmerman shows that he did not resort to deadly force until Martin tried to take the gun, then that would be justifiable homicide if Martin also first attacked Zimmerman as he claims. We will have to wait and see how the defense plays this out.

That would be a good defense, yes. It sure does not explain why the kid was yelling for help, if he was, if it was the kid's voice. If it was Zimmerman's voice, then it would explain it. A lot of focus of this trial will need to be expert analysis of whose voice is heard on the "9-1-1 tapes." We don't know whose it was right now. Dead men tell no tales. The forensic evidence must speak for them.
 
Since the temptation to speculate, or to advance opinions not supported by available facts, seems to be irresistible to some members, we're going to give this one another vacation until there is more reliable material to bring to the table.

That may take a while...

One more reality lesson here - bail. The 10% that was posted initially is not refunded - it's a fee. For a $150,000 bail bond, the fee is $15,000, and the rest has to be secured with something - real estate, or whatever. Bail is not fun. Bail is expensive. Go looking for someone to bail you out, and you will really find out who your friends are.

George Zimmerman was released around midnight Sunday from a Florida county jail on $150,000 bail as he awaits his second-degree murder trial for fatally shooting Trayvon Martin.

The neighborhood watch volunteer was wearing a brown jacket and blue jeans and carrying a paper bag. He walked out following another man and didn't look over at photographers gathered outside. He then followed the man into a white BMW vehicle and drove away.

Moments before, two Seminole County sheriff's vehicles blocked access to the intake building parking lot where Zimmerman was being released. Zimmerman emerged after two public information officers confirmed the credentials of the photographers outside.

No questions were shouted at Zimmerman, and he gave no statement.
His ultimate destination is being kept secret for his safety and it could be outside Florida.

Circuit Judge Kenneth Lester said at a hearing Friday he cannot have any guns and must observe a 7 p.m.-to-6 a.m. curfew. Zimmerman also surrendered his passport.

Zimmerman had to put up 10 percent, or $15,000, to make bail. His father had indicated he might take out a second mortgage.

Some new information has been made public on the injuries sustained by Trayvon Martin and by George Zimmerman in the fatal encounter in Florida. It is now reported that Zimmerman suffered a broken nose; that Martin's knuckles showed evidence of abrasion; and that the fatal shot was fired at close range. The Martin autopsy report also mentions the presence of trace amounts of drugs, not necessarily ingested on the day of the shooting.

This information has been discussed in numerous opinion pages and editorial columns, with the usual slant, depending upon the source.

While it may be tempting to conclude that the few new facts that have become available are consistent with whatever one already believes to have happened, it is clear there are still too many gaps in the evidence that has been made public to support any definitive conclusions. What actually occurred prior to the altercation is of the utmost importance, and at this time, there is only fragmentary evidence and speculation about that.

For this reason, the staff have concluded that the new information does not warrant reopening discussion at this time.

In all likelihood, what happened, and whetheer or not the shooting was justified, will remain unclear at least until the case has been tried, and that may not happen for a long time.

The new information may bolster George Zimmerman's argument that the two men were locked in combat, and Zimmerman shot the unarmed teenager to protect his own life. How easy is it to kill a man in a fistfight?

It happens more than twice a day, on average. Fists and feet were responsible for 745 murders in 2010, or 5.7 percent of all murders that year, according to FBI statistics. (The data on this have been remarkably stable in recent years. In the five preceding years, the percentage of murders perpetrated by fists or feet fluctuated between 5.6 and 6.1.) It doesn’t even take an experienced brawler to punch someone to death: An 11-year-old California girl appears to have killed a classmate with her bare hands in a February fistfight.

SANFORD, Fla. - The judge has revoked the bond of George Zimmerman, the neighborhood watchman charged with shooting and killing 17-year-old Trayvon Martin.

Zimmerman must report to Seminole County jail by Sunday at 2:30 p.m.

The state filed the motion on Friday just before a hearing in Sanford discussing the release of more evidence in the case against Zimmerman.

Prosecutors say Zimmerman misled the court on his finances during a bail hearing that allowed his release on $150,000 bond. Zimmerman's attorney said several days later that he had discovered his client had raised more than $200,000 from a website with $135,000 available. That money wasn't disclosed at the bond hearing.

Judge Kenneth Lester heard the argument at the evidence hearing because he said the matter was "very serious."

State prosecutors said on Friday Zimmerman's wife, Shelley, knew about the PayPal money from his website and lied at the bond hearing when she said she didn't know of it.

O'Mara commented on the state calling Zimmerman and his wife liars by saying, "I understand the states position on it. I don’t agree with it. That’s what adversaries do."

State prosecutors said Zimmerman also had another passport he didn't disclose to the court.

"The defendant lied to this court," said state prosecutor Bernie de la Rionda. O'Mara defended Zimmerman, saying he didn't deceive the court about his passport.

The neighborhood watch volunteer accused of killing unarmed 17-year-old Trayvon Martin passed a lie detector test, according to newly released documents.

George Zimmerman “told substantially the complete truth” when asked about the fatal shooting of Martin, according to the conclusion of a Voice Stress Analysis test conducted after the shooting.

Zimmerman, who is facing a second-degree murder charge for killing Martin, was asked several questions. They include, “Did you confront the guy you shot?” Zimmerman answered “no.”

He was also asked, “Where you in fear for your life, when you shot this guy?” Zimmerman answered, “yes.”
