New Gun restriction proposals in Alabama...anyone heard about this elsewhere?

This may seen a bit tin foil hattish but I think there is a mini revolt among anti Trump judges and don't count on a rash of these ridiculous proposals reaching the courts and us getting an unfavorable ruling. Many liberal judges seen to be thumbing their noses at the Heller decision.

They are trying to take too big of bite at one time for AL

  • Mandatory gun registration- owner has registration card that lists all weapons
  • No transfers unless done through a registration office
  • New purchases must be picked up at registration office
  • Mandatory gun safes; only registered owner will have combination
  • Mandatory gun safety classes
  • Open carry and concealed carry policies abolished
  • Waiting period for gun purchase extended to three months to allow all paperwork to pass
  • People under 21 prohibited from owning guns
  • Extensive mental evaluation
  • Mandatory liability insurance for firearms
  • Required reporting of stolen firearms within four hours of discovery
  • Ammo purchases made only for the caliber gun specified on registration

Wow, those are excessive. Prolly aiming to please a very liberal base without having to do the real work of getting anything passes.

I don't live in AL, but I travel in/through often and like to stop at the Talladega CMP for matches with friends. This kind of anti-gun folly would definitely put the kabash on Talladega as a destination for gun owners in the south. There are a number of other gun clubs in the south with very appealing matches that would probably suffer.

Holy cow - they wanna be Hawaii or New Jersey? I cannot see any of that flying in Alabama...and I would hope the good ol' boys get together and vote the idiots out who had the tiny testosterone to actually support these idiotic Socialist ideas.

I do live in Alabama but had not heard of this Left Liberal fantasy.
The problem with stuff like this is that with it to argue from, the LLs can "compromise" to a less alarming but still repressive measure.

What I do know is going on is a bill for Constitutional Carry that has many political appointee law enforcement managers freaking out.

I have serious doubts this would pass in AL as well but after talking to some friends very few even know about this proposed bill. If nobody fights it then they could certainly try to impose what they would call a compromise and frankly I don't want to see any change in Bama. If anything I thought we were going the opposite direction here with the lossening of laws but as the old saying goes you can't let your guard down in good times either. We need to get this out to everyone we know in Alabama.

Even very red states have small pockets of dark blue (and vice versa). The state house reps/senators from those areas often propose things like this (or the converse in blue states). They are DOA. But the rep/senator gets to tell their constituents that they tried. No. Big. Deal.

I'm from Alabama and would love to spread this to everyone I know to oppose it, but is it legit?

I haven't heard anything about it but it seems so extreme that it has no chance of passing in a state like AL.

There is no bill yet...It's a wish list...

From the link in the OP:

"Joining Frank Matthews, President of the Outcast Voters League, at the press conference was State Rep. John Rogers, who announced he is aiming to “fashion a bill that’s passable” to enact gun control in the state."

They are trying to take too big of bite at one time for AL
I was thinking the same... several items are too big alone, much less rolled together, to realistically get passed. Makes you wonder if the banners are that delusional to think this even had a prayer (possible), or if they introduced it, knowing it would fail, but would be able to proudly cry to their liberal friends/supporters "we tried to save them from themselves, but those idiots 'cling to guns [and] religion...'"

I don't live in Alabama but my sister and brother-in-law live in Mobile. He obtained his concealed license a number of years ago, but it was later revoked by local law enforcement (don't know if it was the Sheriff or Chief of Police). He was given no reason at all after inquiring as to why. He has no criminal history, no arrests, and is a local business owner with 5 kids, one of whom attends the University of Alabama School of Medicine on a full scholarship. I didn't know Alabama's laws allowed such a thing to happen, but it leads me to wonder whether some law enforcement officers in that beautiful state aren't too keen on law-abiding citizens having a license to carry.

I live in Alabama.

Equin, as of 01/08/2013 the Sheriff of every county has to issue a license or provide reasons why not and the issue can be resolved in court:

Alabama code 13A-11-75

http://alisondb.legislature.state.al.us/alison/codeofalabama/1975/13A-11-75.htm

Permit to carry pistol in vehicle or concealed on person - Issuance; fee; revocation; release of information.

(a)(1)a. The sheriff of a county, upon the application of any person residing in that county, within 30 days from receipt of a complete application and accompanying fee, shall issue or renew a permit for such person to carry a pistol in a vehicle or concealed on or about his or her person within this state for one- to five-year increments, as requested by the person seeking the permit, from date of issue, unless the sheriff determines that the person is prohibited from the possession of a pistol or firearm pursuant to state or federal law, or has a reasonable suspicion that the person may use a weapon unlawfully or in such other manner that would endanger the person's self or others. ...

(3) A person who is denied a permit under subdivision (1), or a person whose permit is revoked under subdivision (2), within 30 days of notification of the denial or revocation, may appeal the denial or revocation to the district court of the county where the denial or revocation was issued. Upon a review of a denial under this subdivision, the sheriff shall have the burden of proving by clear and convincing evidence that the person is prohibited from possession of a pistol or other firearm pursuant to state or federal law or, based on any of the considerations enumerated in subsection (a)(1) that the person may use a weapon unlawfully or in such other manner as would endanger the person's self or others if granted a permit to carry a concealed weapon under this section.

As for the above proposed silliness No Way, No How, Not Here, Not Now, Not Ever. :cuss:

Those look like EU type gun laws. This would never work in USA and especially in Red State like Alabama. Passage of something like that would probably lead to mass demonstrations there.

Can't find anything about this on the Alabama news websites (al.com or yellowhammernews.com). Probably won't pass but worth keeping an eye on it anyway. Slippery politicians like to add amendments to laws that few people ever read.

Nothing new. Legislators in many states, usually from large urban areas, introduce garbage like this all the time knowing full well it hasn't got a chance of getting out of committee for a vote. When it's defeated they can return to their constituents and say they gave it a valiant effort but them nasty conservatives don't want "meaningful" gun legislation but vote for me again and I'l give it another try.

Thanks, Jellyjar for the info on Alabama laws. I noticed the effective year of 2013, which was some years after his license was revoked. Sounds like others had theirs revoked without any reason given and the legislature wisely passed a law requiring the notification, reason for revocation and opportunity for appeal. Sounds like it may still cost a revokee some money to hire a lawyer and appeal it in district court, though, which doesn't sound ideal, but I guess it's better than nothing.

Are real rights subject to revocation by bureaucrats until one successfully appeals in court?

Would we tolerate that for the right to vote? The right to free speech? The right to attend church or read the Bible?

Would we even tolerate that for a revocation of the driving privilege?
