Any recent approvals?

My very first form 4 came with a lick and stick stamp in 2011. I short barreled two AR lowers and they both had a peel and stick stamp in 2012. All the rest came by email in a PDF.

I really like the eForm 1's. I'd heard people getting them approved in less than a month, but I was skeptical.

Sent one off to SBR a 10/22 June 2020, it was approved in 23 days.
Sent 2 off to SBR a CZ S2, and a 9mm suppressor kit in July 2020, those were approved in 17 days.
April 2022 I sent one off to SBR a HK SP5, that one was approved in 10 days.
June 2022 I sent one to SBR a HK SP5K, it took 25 days for approval.
you are like the SBR king, all in a gun trust?
 
Yes I think there is a widespread ignorance of the form 5 for inheritance without another tax .

From the ATF.

"The firearms may be transferred on a tax-exempt basis to a lawful heir. The executor would apply on ATF Form 5, Application for Tax Exempt Transfer and Registration of a Firearm, for a tax-exempt transfer to a lawful heir. A lawful heir is anyone named in the decedent’s will or, in the absence of a will, anyone entitled to inherit under the laws of the State in which the decedent last resided. NFA firearms may be transferred directly interstate to a beneficiary of the estate. When a firearm is being transferred to an individual heir, his or her fingerprints on FBI Forms FD-258 must accompany the transfer application. However, if any Federal, State or local law prohibits the heir from receiving or possessing the firearm, ATF will not approve the application."
 
Individual, never set up a trust. All my family lives 900 miles away.

This keeps my friends from trying to borrow my cool stuff.

All my guns are willed to my daughter, all she has to do is file a ATF form 5 along with a death certificate, and their all hers.

How are the NFA items stored until approval? Local FFL?

No.
The estate maintains possession. ATF allows 90 days to file the Form 5 I believe. Anyone relying on that ought to include a prefilled Form 5 with their will or trust.

Transferring to an FFL means a Form 4 and $200 tax..........and negates the ability of the tax free Form 5 to the beneficiary from that FFL.
The estate could deliver any NFA firearms to an FFL for "gunsmithing" without need for a Form 4. But there needs to be bona fide gunsmithing performed, not just storage. Gunsmithing services might include cleaning and/or a function check.;)

Ok, I'm confused now as well.

I'm not aware of a CLEO sign off. All that is required is that you provide them a copy of the form.
He's talking about a non over the counter transfer. It's intended for those who live in remote areas with no nearby FFL/SOT. While the CLEO doesn't "sign off" on the Form 4, the nonOTC procedure involves the buyer filling out the 4473, getting it notarized, then sending the buyers Form 4473 to his CLEO and receiving it back. If it happens inside of two weeks you have a fast CLEO and excellent service from USPS.

Silencer Central loves to brag about their awesome "we can ship to your doorstep" and people often think that's so cool, not knowing the ramifications. So does Capitol Armory and others.
Any FFL/SOT in your state can do a nonOTC transaction, but few do because it adds time to getting the silencer into the customers hands. It also relies on the local CLEO doing his part. And the process for the FFL/SOT is a bit different than a normal OTC transaction.


Silencer Central acts like they invented it, but Silencer Shop did it in Texas over a decade ago when they were a retailer.

Thank you, it is always good to know why something is done. This is my first suppressor but won't be my last. I will also be looking at some other dealers as you talked about in another thread.
 
I just got my eform 1 approval today. Submitted 2/2/2023. This agent must have been feeling frisky to be up at 6am approving form 1s.
 
I also just certified my form 4 for my Ghost 45M. So in about 300 days I'll be back in this thread.
