Hello, I'm waiting what seems like forever for the dlr to dlr transfer, so I Can start the even longer wait for the stamp and was over thinking.
When I mail in the form 4, I have to include a check for $200 to ATF, and currently checks are only good for 90 days, so they'd have to cash it within those 90 days. If they cashed the check to buy the tax stamp without the intention of sending the item they are selling, wouldn't that be mail fraud? So wouldn't that give them a defacto time limit of 90 days to approve them? I'm not sure who's bigger the ATF, or the US Post office.

Hire a lawyer and file suit against them, see how long that form 4 takes :D

I really doubt it the ATF is not "selling" a product they are rendering a service approving your form 4. I do not believe that government entities are subject to business law either.
 
You're "over-thinking," all right. ATF cashes the check as about the first step in the process. If, later, the transfer is not approved, they'll refund your money. The long delay is the way the NFA world works these days. You have to have patience as well as money to play in this game.
 
Yep. Settle down for the long haul. It never gets any cheaper, and it never gets any shorter. As mentioned above, it's the way of the NFA world.

My suggestion - just forget about it. It'll happen when it happens, and no amount of harassing ever changed the pace at which it occurs.
 
I'm in the same boat as you. It's been over a month and I'm still waiting on the Form 3 to be approved then the (seemingly) eternal wait on the Form 4..
At least there will be time to research accessories, ammo, etc. :)

Never heard of checks being good for 90 days but from what I've heard, BATF deposits them pretty quickly..
 
The long delay in processing approvals has a serious damping effect on the NFA-item market, much more so than the $200 tax or even the need for CLEO signoffs (or the need to form trusts, in lieu of signoffs). With the Hughes amendment in place (freezing the supply of MG's), if ATF processing took only a month or two, the prices of MG's would be even higher than they are. If somebody is older (I'm 67), one hesitates to get into this kind of transaction, not knowing whether it would be approved before one leaves this mortal existence. Not only that, but the delay could tempt dealers into skullduggery, playing fast and loose with a client's money.
