Rights of expression go both ways Cajun. I do NOT have to silently tolerate the views of those who would take away my rights.

No. You do not silently have to tolerate those views. That is different than telling him he cannot express his views, which is what you did.

If he's serious, he needs to keep his opinion to himself, or move someplace more in line with his way of thinking...

(Bold type added by me.)

Come to think of it, some nekkid pictures in the Atlanta airport would probably be more pleasing than the aging art from the '96 Olympics. So yeah, I would support him hanging porn in the airport...nothing prettier than the female form except maybe one holding a sexy EBR.

Well, I know that there was a news conference held at Atrium Tower this morning that was not televised, contrary to what was planned. I know that Tim is still picking up family this morning at Hartsfield. And I also know that Tim and GCO are planning to sue for compliance with GA Code 16-11-127 as revised in HB89.

I expect to know more in the next couple few hours.

TAB is right, using something like skin-color to ban is different than using something like being armed, which you can choose to be or not to be.

I think a better comparison would be if they banned all Christians or Jews or Muslims from being in the airport. A Religion-Free Zone.

"Faith has no place in this post-911 religion driven terrorist world! Even though every person has a right to the faith of their choice and this right is protected by Federal and State laws, we're going to ignore that and arrest anyone wearing a Star of David, or a Crucifix or any other religious paraphernalia."

TAB- "Anyone who goes there with faith-based items on is grandstanding for attention, not standing up for their rights. You can CHOOSE to be religious. The Airport Dictator has every-right to infringe upon the rights of the citizens that he works for. It's for the children."

Give me a beak Tab. :barf:

So what's the more to this story?

Establishing standing could be problematic, as (AFAIK) there is not published airport policy, nobody has been denied anything in writing, and nobody has been arrested - it's all just hot air at this point. A confrontation would have turned the chest-thumping into an actual actionable instance. As we learned in Parker, no harm, no foul; this is going nowhere until someone gets arrested, and now that's likely to be some unsuspecting citizen ... unless there is indeed more to this story.

CNN is broadcasting live from Hartsfield right now about HB89 and the growing conflict between Bearden and DeCosta/Franklin.

The anchor has just asked the correspondent broadcasting from the airport what is the process for a GFL issuance.

She got the probate court right and the FBI check, but forgot the GBI (Georgia Bureau of Investigation) and NICS check. FAIL.

Intune

ROFL! You have a point - yes, one must be at least a LITTLE crazy to ride a motorcycle in Houston traffic - especially through the 59/610 interchange :D

(For those who don't know - that is the busiest intersection in the state and in the top 2 or 3 in the nation, and yes, i commute by motorcycle)

Frankin and DeCosta were named in a federal lawsuit by John Monroe, an attorney with Georgia Carry dot Org, filed this morning. Tim Bearden is the plaintiff. I haven't yet seen the complaint, so I don't yet know exactly what the legal basis is.

I'll update this thread as more information is made available.

ATLANTA -- A state representative and a pro-gun group have vowed to challenge a "gun free zone" policy at Atlanta's Hartsfield-Jackson International Airport by filing a lawsuit, saying the ban violates his civil rights.

During a news conference Tuesday, Airport General Manager Ben DeCosta and Atlanta Mayor Shirley Franklin declared that the airport would be a gun free zone. The pair cited city attorneys' advice that said the airport was covered as a public gathering place and therefore could allow for a moratorium on handguns.

Immediately following the news conference, Franklin and DeCosta were served subpoenas for a lawsuit filed by GeorgiaCarry.org.

"Ben DeCosta cannot trump state law or the constitution of the United States," Georgia Representative Tim Bearden (R, Villa Rica) said during an interview on CNN Tuesday morning.

Monday Bearden said he had plans to pick up some family members at the airport on Tuesday and would carry his personal weapon with him. DeCosta said he could identify Bearden and threatened to have him arrested if he brings a gun onto airport property.

Tuesday, Bearden moderated his stance, saying he still planned to visit the airport, but would not be carrying a firearm. He cited the airport's "illegal" policy as the reason for a federal lawsuit he plans to file. "It shouldn't be this way. We have a state law in place. We have a United States Supreme Court ruling in place," Bearden said.

During his interview on CNN Bearden also questioned the airport's ability to enforce the gun ban citing the many sport shooters who travel with firearms in their checked baggage.

So he didn't go thru with it... what a shock...

I still find it very funny that he had to "run to mommy" in federal court to get this resolved...

I think that says alot about the goverment in GA.

TAB = Troll?

I didn't know we started spelling TROLL, T A B.

Dude you said earlier that he should file paperwork to resolve this. Guess what, he did just what you wanted and now he's "Running to mommy."

TAB said:
he is doing it for his own ego... if he wasn't, he would have just filed papers, instead he made a public threat. I hope they throw the book at him.

So now that he "Filed Papers" he's running to mommy in federal court to get it resolved....

Go bother some goats on a bridge.

Did I say what paper work to file?

This could have been handled in GA, by GA. Instead he is looking for "mommy" to come save him since the people of GA can not. And yes if I was a GA state resident that is EXACTLY how I would look at it.

He is a public figure it is his job to be in the public eye that is how politicians affects change. It amazes me the number of alleged gun owners who are secret anti's. Pro self defense pro Bill of Rights gun owners constantly struggle to have our representatives stand up for our rights. Here we have such a man. A public figure who publicly stands up for the law, the Constitution and the Bill Of Rights as he is sworn to do, unlike many others. A public figure publicly standing up for us and our rights, accomplishes several goals he could not accomplish by just quietly working in the background to assure the law is eventually followed. Significantly his action will prevent a private citizen from having their lives completely destroyed, should this fascist airport manager have them illegally arrested. Instead he will offer himself up to take the risk and endure the legal battle that is sure to follow, once the arrest occurs. Not to mention the fact that as a public figure a legislator he helps enlighten the public to the fact that gun owners, Americans that support the Constitution of the United States are normal law abiding upstanding members of the community not illiterate inbred blood thirsty red necks the anti civil rights movement attempts to portray us as. He does so at no small risk to himself either. For he is sure to invite the wrath of the antis and expose himself to the full force of the antis who will strike out against him to discredit belittle him and cost him his career. That is already going on now here on the thread. Look at how many already attack this man for being publicly pro gun pro. It makes me wonder how many secret antis are here that support the Brady Bunch by lashing out at anyone who publicly supports gun carry

Your a troll dude. Tim Bearden is a fine statesman, gentleman, and not least, a father and a husband. Think about that for a minute. It speaks volumes of his mindset as to why he didn't "go thru with it." This is not some stunt for the man and has serious repercussions for him, both legally and socially.

As a northern transplant, from a place where no one stands up for their rights, certainly not 2A, I am proud to know Tim Bearden, proud of what he stands for, and proud to be a Georgian. I only wish I lived in his district.

In case you haven't noticed, America is a nation of laws. When your civil rights are violated, you sue for reprieve. That's what makes America America. Ben DeCosta and Shirley Franklin think they're above the law. They plan to enforce their version of the law that has no basis in Georgia Code. They have to be cut down to size by using the courts. That's not running to mommy. That's where the rubber meets the road. That's standing up for the little guys like me and most other people who've commented on this thread.

"really so a some one can't stop another person from coming onto thier property? when do you want me to move into your house?"

I smell TROLL

So moga, how do you feel about YOUR states goverment not being able to enforce the laws it passes with out enovling the federal goverment?

Forget this example, as a whole how do you feel about that?

from the news article

The pair cited city attorneys' advice that said the airport was covered as a public gathering place and therefore could allow for a moratorium on handguns.

The public gathering place language in Georgia's law is still there and the biggest damn crock of unnailable jello imaginable.

Disappointed Bearden didn't show up for the gunfight but oh well. He has already proven his mettle to me.

Has anyone pointed out that to fight an action like having someone wrongfully arrested for legally carrying in the airport someone actually has to be arrested?

Until someone is harmed by this administrator's misdeeds it is all theoretical.

nope not playing around at all. I this guy (huh?) just wants to get relected(reelected), I also beleave(believe) that property owners( or person in charge of said property, even if its owned by the the public) have the right to restrict what happends(happens) on said property.

In an effort to attack the post and not the poster(TAB) I must point out that there are glaring grammatical errors as well as logical errors.

TAB what exactly do you think should happen in this instance?

The cities attorneys are so incompetent its a joke. Which is why Atlanta continues to lose to GCO in court. Now that the public transportation language has been stricken from 16-11-127 by HB89 being passed into law, AHJIA is NOT a public gathering and Franklin and her anti-cronies know it.

You know what really angers me? That the mayor can't get a grip on crime in the city of Atlanta, so she decides to try and make law abiding people like myself into criminals by threatening them with arrest for perfectly legal conduct.

She's been sued in the past for pulling stunts like this. Like when she threatened to arrest anyone in Atlanta parks for lawful carry by GFL holders, when state law clearly preempts municipalities from enacting any firearm laws or codes. We all see how that one went down.

TAB seems to think that Bearden should have contacted his state representative and had him handle it.
