TWIN FALLS, Idaho—Ryan Horsley seems confident that he will triumph over a government shakedown that has cost his family business about $200,000 in legal fees, as he fights to keep Red’s Trading Post, a fourth-generation firearms store, in operation.

Red’s is Idaho’s oldest surviving firearms dealership. Sometime this summer, federal judge Ed Lodge, who’s best known for presiding over the dramatic Randy Weaver case, will decide if the federal government is right in claiming that Red’s “willfully” violated the law by making a relatively small number of clerical mistakes in its firearms sales records.

The Bureau of Alcohol, Tobacco, Firearms & Explosives (BATFE), a relic of the prohibition days whose modern-day legitimacy is an open question, has been poring through the store’s sales records since at least 2005, looking for such “willful” clerical violations.

Although Horsley at first thought that the BATFE would not push the matter into court, in order to avoid any bad publicity that may accompany a ruling contrary to the government’s position, the matter did go to court on March 3-4, 2008 in Boise—about a year to the day since the battle heated up.

In early March of 2007, the federal agency revoked Red’s Federal Firearms License, but a judge granted an injunction against the BATFE to halt that process, thereby allowing Red’s to continue operating in Twin Falls, where another firearms dealer, Blue Lake Sporting Goods, was shut down by the BATFE. In that case, the store turned in its FFL and buckled under the weight of legal expenses.

Horsley, a particularly irrepressible man who so far has resisted what could easily have plowed his store under, told AFP on March 26 that he feels good about the court proceedings, believing that the government did not convince Judge Lodge that the store is a menace to public safety and deserves having its FFL revoked.

The FFL allows dealers to buy and sell firearms; revoking it would doom the store. Horsley also recalled that when the BATFE first tried to revoke the FFL, it claimed that Red’s was a “threat to public safety” but turned around and said that Red’s still could sell the 1,000 or so firearms already in stock—as long as it did not order additional guns to sell.

“You see what I’m up against?” Horsley said. Horsley’s attorney, Richard Gardiner, told AFP that Red’s largest number of clerical errors on BATFE Form 4473 involved something simple, such as not listing the county of residence of the gun-buyers. But he added that all these forms included zip codes. Many of the purchasers are from Twin Falls County, which has a city of the same name.

Gardiner thinks that Red’s practices do not break federal regulations in listing only the city (plus the zip code), even if the county of residence is sometimes not listed.

“We take the position that the regulations do not require both [city and county]” Gardiner said.

So, why did the BATFE bring what appears to be a weak case to court? Horsley’s view is that the agency cannot very well spend $3 million just on its case against Red’s—to try to revoke an FFL that cost the store just $300 every three years to maintain—and then drop the matter.

“If they just back off, they would have nothing to show for it,” Horsley said, as he struggled to comprehend why $3 million in taxpayer dollars have been spent on a case where no evidence has been found to suggest that Red’s has knowingly put guns into the hands of criminals or committed some other serious act.

Horsley feels the BATFE simply is trying to portray Red’s as a bad place, which, however, is a little tough, considering that local police officers have worked there.

“Many times we’ve had part-time law enforcement officers working for us,” Horsley said.

The local sheriff, Wayne Tousley, told AFP in a 2007 interview that, as the chief law enforcement officer of Twin Falls County, the BATFE is supposed to come to him first to conduct its investigations. But he said then that the agency typically bypasses him.

Nice shop good folks, we bought a gun there last week. ATF is outa control it seems to me.
 
So he's apparently allowing buyers to skip required portions of the 4473 and is surprised for getting into hot water over it? Don't get me wrong, revoking the FFL seems harsh, but on the other hand it would seem wise to be extremely vigilant about paperwork to avoid this sort of thing.

I have a friend who is thinking of not renewing his FFL because he is worried about what an audit would do to him.
 
I'm so glad these guys are putting up a fight.

I only hope that once this is through and if they win, that they continue to press the government about unscrewing the BATFE.
 
Plain and simple harassment by the ATF folks.

What a shame to see a family business crushed like this by a federal Department that needs to be reduced in staffing numbers.

I hope whoever inside the ATF initiated this BS investigation finds himself either retired or fired.

I pulled my copies of 4473s from when I lived in Maryland and I lived in Baltimore city therefore the county of residence line on every one of them is blank. City says Baltimore, County is blank. They are trying to trip people up with confusing BS your postal address is all that should be required the zip will tell them exactly where you live.
 
The form is a federal form, so every spot should be filled in. I can see Red's getting dinged for it by way of a small fine. $100 per infraction (not sure what the actual fine is) is no small dent when you consider a profit margin of about that amount per gun.

However, the BATFE's actions on this are clearly directed towards shutting the guy down over minor clerical errors. Leaving the County blank? It was extremely easy to do on the old yellow form(that didn't have the boxes or separations between fields) and almost as easy on the new ones.

No guns were proven to have fallen into criminal hands. No guns were missing. What real solution is this BATFE action providing to what problem?

I don't think we should have to pay for this crap. The legal expenses on both sides should be pulled from the BATFE budget when they fail to prove their case.
 
I work at a sporting goods store in the same state and we go above and beyond to make sure the 4473 forms are filled out correctly and completely. Why wouldn't anybody with a FFL require somebody enter the county on the form? Does it take too long? What difference does it make if their city is the same name as the county? I'm not supporting the BATFE's behavior, but I would think the smart business owner would do what they could to retain that FFL.

Is there any truth to the rumor that the retailer involved in the lawsuit was taking pictures of the agents and posting it on their website? If one were to do something like that, I could see why the BATFE would be so persistent.

Based on past observation I'd say that it's more likely that they would get promoted! :barf:

5692. iwas contemplating purchasing a stripped oly arms ar-15 lower from them only days ago. seems like my money will be well spent there.

That is an incorrect assertion on the Sheriff's part, which is neither here nor there.

That said, I wish Red's good luck absent some clear evidence of willful wrong doing.

Feds, gun shop reach deal

BOISE, Idaho -- An Idaho gun shop that went to federal court to keep the Bureau of Alcohol, Tobacco, Firearms and Explosives from stripping it of its gun license has reached a tentative settlement with the government.

Attorneys on both sides told U.S. District Court Judge Mikel H. Williams on Wednesday that they had likely agreed on how to end the case.

Mark Geston, an attorney representing Terry and Ryan Horsley of Red's Trading Post, said he could not yet release details, but said the proposal would allow the Twin Falls gun shop to continue operating.

"I think everybody's reached a cooperative and constructive agreement," Geston said Thursday. "The judge said to have it finalized in 10 days and we'll just do our best to do that. The agreement allows Red's Trading Post to continue as a gun shop in Twin Falls."
