A federal judge has - for now - given his family their gun shop back.

A federal agency revoked Red's Trading Post's right to buy and trade guns again after finding the gun shop had committed errors in its gun sales.

But U.S. District Judge Edward J. Lodge ruled Monday that the Bureau of Alcohol, Tobacco, Firearms and Explosives had exaggerated and omitted some of its findings used to justify revoking Red's license.

And Lodge granted Red's March 20 request to stall the ATF's sanctions until he reaches a final decision on whether revoking Red's license was legal.

"It was a great decision," Horsley said. "I am ecstatic. I was just waiting. For nearly two months this has been exhausting."

Horsley, whose gun inventory had dropped from 1,000 to 160 guns, is reopening suspended accounts - both on the distributor side and in advertising. His largest distributor agreed to hold $200,000 of merchandise while the dispute goes to court. Now, Horsley is hoping his sales, which had reached their pinnacle in more than 70 years of business, will spark back up.

Lodge wrote:

• "The ATF speaks of violations found during the inspections of 2000 and 2005, but fails to reveal that additional investigations in 2001 and 2007 revealed no violations or problems."

• Some violations had been counted twice.

• "Granting the preliminary injunction would not place the public's safety in jeopardy."

• Between the hardships Lodge's ruling would cause the ATF and Red's, "the relative hardships tip sharply in favor of Red's."

Lodge's injunction grants Red's full operation status until Lodge makes a final ruling at an unscheduled future hearing.

"I have been getting all these calls from distributors and manufacturers, and everyone else, just congratulating us. You should see my inbox right now," Horsley said. "Getting all our advertising back in place, getting all our orders set, arranging - it's just kind of nuts. It's not over yet."

Wasn't Lodge the same judge that tried the Weaver case? If so, maybe we need to put some pressure on the right people to get him to the SCOTUS when the next vacancy comes about.
 
Does this guy do out of state sales?

I'd be willing to buy a rifle to help him get back in the saddle.

fantastic stuff, they have really been abused, if i lived in the area, i'd buy from them right now, even if it was just supplies!!!
 
OK everybody...

Anybody and everybody that can, try to get out there and buy from Red's. A box of ammo or other supplies at least. "We stand together or we will surely fall alone." I stated here in another post that I would support him with my dollars as well as my voice. I live in Seattle but I went out there last Sunday, and he was closed :eek: I'll be making another trip out there soon to visit a friend of mine and pick up a case of 9mm on the way.

Mr. Horsley, set aside a case of brass cased 9mm ball for me. I like the heavier ones, 125's or 147's. I'll be there within a week or two. I need some primers and a few lbs of 2400 too......:cool:

I spend quite a bit at Bullseye in Tacoma for the same reasons. Any of you guy's n gals in, or come through here, stop in and grab a box of ammo. Heck of a sale going on right now. :) Great bunch of guy's and the best service in the area.

Just in case the ATF is compiling a list of Red's supporters..... :cuss:

BATF, no need for the 3am surprise visit. Gimme a call and I'll put on a pot of coffee and get some doughnuts in. Drop in and set a spell.... We'll discuss the mysteries of the constitution and bill of rights. :D
 
congrats for Red's. The charges were trumped up to make him look like a villian. I hope the judge comes down on his side in the final hearing. The BATFE needs to learn that spelling errors are not the source of firearms crimes.
 
Cameras

I think all gun shops should have cameras tied to the Internet when the ATF walks in. :neener:
 
That's good! Nice to see the ATF lose in court!

I bet, though, the BATFE will be watching them very closely, so I hope they are very careful with the paperwork to avoid letting the BATFE try anything more...they don't give up too easily, they're too arrogant...
