The fact that the BGs were using an imitation firearm is irrelevant. It appeared to be a real weapon and Buddy was in fear for his life. That is what is required.
You may have misunderstood my question. It is of course irrelevant to Buddy what these numbskulls were pointing at him. I was just curious why gangsters would be stupid enough to use a toy. Another poster mentioned the penalties might be less severe.
It's not quite that bad here. As of 2007 (from the latest statisitcs on the CA DOJ website http://ag.ca.gov/firearms/forms/pdf/ccwissuances2007.pdf), there were just over 40,000 CCW holders in CA. I suppose that number has gone up some since November 4th. If we ever become "shall issue" it will go up considerably.
rainbowbob - I'm sorry, you are right. My only answer to your question would have to be something about the availability of imitation firearms vs. real firearms. Most of the willing victims these guys hunt don't react any differently to imitation weapons.
