(Walker, April 26, 2005, 5:54 p.m.)
A homeowner who shot at a man breaking into his home will not face charges.
The crime took place at a home in the 1400 block of Wilson Avenue around 6:30 a.m. Sunday.
One of the men accused in that home invasion, 20-year-old Marcos Fernandez, was charged Tuesday with first-degree home invasion, conspiracy to commit home invasion, felon in possession of a firearm, felony firearm (firearm used in the commission of a felony), and being a habitual offender.
Police say the homeowner woke up and found Fernandez in his home, fired a gunshot and hit the robber, who then fired back but did not hit anyone.
Fernandez was treated for the gunshot wound at a hospital.
Police are still searching for a second suspect – 21-year-old Andre Cardoza.
If you have any information about this crime or Cardoza's whereabouts, you're asked to call the Walker Police Department.
