So I finally got my trust together, money together, and today in celebration of July 4TH I efiled two form 1 applications. One for a suppressor in 30 cal, and one for an SBR from an 80% lower ar 15. Why the 80% you ask? Well, in Washington a trust can't own a title 1 firearm, so "the trust" has to build it from scratch. Weird rules, but we couldn't even have an SBR or shoot with legally owned suppressors until recently, so I guess I won't complain. Now I need to figure out how to be patient until i get my paperwork back... I hate waiting... Happy 4th!

Btw the second form took 3 minutes to fill out and pay for. Crummy website, but once your account is set up it goes pretty quickly.

Yeah, that site leaves a lot to be desired.

Anyhow, welcome to the NFA waiting game! The only good thing is that everyone eventually wins. One of my first NFA items was a full auto. Imagine paying $5,000 for something that sits in NFA jail for (at the time) almost 8 months! It was a brutal wait!!!

"Well, in Washington a trust can't own a title 1 firearm washington"

Can you elaborate?

My NFA trust (drafted by a WA atty who specializes in them) has provisions for a Schedule B, intended to list any or all of my title 1 firearms.

Gratz on joining the club! It's best to focus on other projects while waiting, makes it go by faster.

I too would be curious about Trusts not owning Title 1 firearms in WA. Doesn't seem right. Because remember, an SBR can be in a Title 1 configuration and even sold just like a Title 1 firearm (the new buyer obviously cannot put it back to an SBR without filing for his own tax stamp).

Form 1's seem to be taking about 4 months but I'm sure there is a surge right now before July 13.

My attorney from Arsenal Attorneys informed me of the trust stipulation Washington has. People have gotten around it but Washington law supposedly doesn't allow it. I guess maybe it doesn't matter since it's changing legal configuration, but that's what my research has lead me too. I don't mind, i have a mill and an 80% is a few hours work max, plus i can do my own receiver markings the way i want to. I would be interested to hear if anyone in Washington got an sbr stamp approved from a regular finished receiver...

Sorry, what do you mean by that?

"... Washington law supposedly doesn't allow it...that's what my research has lead me too."

Can you share that research? Do you have a particular RCW in mind? Some case law?

I can go find it again, i don't have all the research i did here with me. Kinda wishing i would have printed it all out since i spent about 6 weeks reading stuff...

Maybe worth a new thread in legal to drill down to it? You would think if Title 1 firearms are prohibited in a Trust that NFA items would also be prohibited.

I agree an 80% is certainly a good way to go, but I know many of us are far more curious as to this strange law.

This section of the site seems pretty sparsely used so I figured I'd just ask here instead of bumping an ancient thread or starting a new one.

It's my understanding you need two copies of everything to send the ATF, so does that literally mean a copy or do I have to fill out two of each form and in the case of an individual have my CLEO fill out both forms and include two fingerprint cards and two passport photos?

Also, I see a lot about cutting down barrels, but would putting a shoulder stock on a AR pistol or something like the Scorpion Evo still be a form 1?

Thanks for any info!

Two copies of your forms, not sure about the other stuff since I file as a Trust.

Putting a stock on an AR pistol or Evo is still a form, same as just clicking a short barrel upper onto a rifle lower.

Congrats. I sent my forms in last week and they cashed my check on July 1. Now I wait and try to forget that my can is in jail. I just figure I'm getting a Christmas gift.

I'm pretty sure that's not true. Northwest Gun Law Group is by far the biggest and most respected NFA trust firm in the state, and they specifically write their higher-end trusts to include all of your Title I firearms. I have a trust set up by them, and just like pintler, my trust has a Schedule B that is written to include all of my Title I firearms.

Yeah, I sent another one in last night and I'm assuming Christmas at the earliest but wouldn't surprise me if I don't see it until February. Oh well, just gotta focus on other projects while we wait.
