Hello all! Since I wasn't able to get my eform in on the 12th for my next can, I guess I will be jumping through the extra hoops. That said, as I understand it the new process required for trusts is as follows: all responsible parties within the trust must submit with whatever form be pursued, two fingerprint cards, a current passport photo, and undergo a background check. That is along with the normal two copies of your trust paperwork and 5320.xx form. Also, the cleo must be sent a copy of your application (form 5320 and trust paperwork I believe) at the time of submission.

My question is how to document the background check. Can a gun store give you an approved 4473 to include in your packet? And can/will they do this for a form 1 suppressor, since there isn't a serial number to work with?

I am pretty new to the nfa game, haven't even received my tax stamps back on my first submissions yet, so I'm trying to make sure I know how to properly file the new paperwork and can avoid delays or denied forms! Plus, it seems timely to ask these questions since we all are going through this together...

Ha, Ha, NO! I went through all this stuff last week and before so I would not have to go through the new stuff for years to come.

However, I do appreciate you guys that will be the Ginnie pigs :evil:

Hopefully a republican administration will do away with this new BS, and get suppressors off the list.

The ATF has issued new forms. You MUST use the new forms. All older versions of the Form 1 and Form 4 are obsolete.

Take a read here:

Then scroll down until you get to the new forms.

Let's say you want to submit a Form 1. Here's what you need to do.

Download the new Form 1. Download the 5320.23--that's the Responsible Person Questionnaire.

Each one of your trustees, including YOURSELF, must fill out a copy of the 5320.23. On that form, you affix a photograph. You will also submit the fingerprints for each trustee on the FD-258 fingerprint cards. (Those can be ordered from the ATF. You have to use actual cards.)

There's a copy of the 5320.23 for the ATF and a copy for the CLEO. When the ATF gets their copy, they do a background check. The CLEO copy is how you provide notice to the CLEO, per the new regulation.

The new ATF Form 1 has three copies in the 12-page form. There's an ATF copy, an ATF 2nd Copy, and a CLEO copy. Obviously the first two copies go to the ATF. (One comes back to you with the stamp affixed.) The first copy has the payment information, but the second two have that information grayed out. Remember that the ATF Form 1 has to be printed front-and-back. There's a small issue with that. When you print the form two-sided, the third page of ATF 2nd Copy and the first page of the CLEO copy are on the same sheet. So you'll need to re-print that single page (page 9-10) before filling it all out. All three copies need an original signature.

You only need to send a copy of your trust to the ATF. Not to the CLEO. And you only send ONE copy of your trust to the ATF.

That should cover the basic process.
