Not necessarily; it depend upon how a state's laws are written. Not having a license ≠ unlicensed.
If you are licensed to drive a car but due to forgetting your license do not have it in your possession during a traffic stop are you an unlicensed driver, or merely a driver without a license? Most states (no citation) likely admit the possibility that a licensed driver may not have his license on him at all times.

In the instant case, unless the law compels her to produce a license upon the request of an officer, it's up to the state to prove that she doesn't have a license and not up to her to prove that she does. Not producing a license when not required to by law isn't doesn't make it a reasonable assumption (RAS) that one is unlicensed.

I did some digging last night while at work & found out the NY "community activist" who got caught with a loaded handgun on school property near Buffalo New York just got a slap on the wrist sentence.
He must do community service & not get in any trouble for a period of time, then his record will be cleared. :rolleyes:
I don't recall if the political activist/community organizer's CCW license was revoked but I think he can retain it by meeting the court mandates.

He got extremely lucky considering the conditions(bring a gun on a school campus, cause a security lock down & SWAT call out).

The guy has a valid CCW license but used the "hey I forgot I was armed" excuse. :mad:
He too supported SAFE Act measures & anti-2A laws.
 
Cops get instant information on CCW's in Michigan. All they have to do is "run" your drivers record on the computer. Bingo- if you have a ccw it's right there in lights.
I can't figure why any other state has a different computer system setup. The cops want to know before they pull you over if you might be carrying, thats why.

License plate doesn't equal drivers license. In Utah, the DL is linked to the CFP but the vehicle registration isn't, at least not directly. Most of the LEOs here assume that someone in the car is carrying, either legally or illegally, on every stop. Most of them relax some if they find out that the driver has a CFP. A few go the other direction and don't differentiate well between legal and illegal carry.

On top of that, anyone in Utah that is of age and can legally own a gun can carry a loaded handgun, concealed or open, in their vehicle (or one that they're operating legally and have permission of the owner.) That makes it a little more difficult to determine who's carrying legally just from the DL.

We have the same system in Arkansas. A cop once asked me how I liked my .45 -- he had run me and knew I had a CHL, and alerted by that spotted my spare mag carrier (which is a carrier for a large multi-tool.)
